I have been on the lease a year longer than him. When the current lease expires, I won't sign it with him, as I cannot continue to live with him. But, I would really like to continue living in my apartment. So, when it comes time to renew the lease, is there any way the landlord will allow me to leave the current lease, and then give me the option for a new lease, as I have seniority over the other tenant? |

You can refuse to sign the renewal, but that means moving out if your roommate isnt. Just because you have lived there a year longer than your roommate, doesnt give you the right to try to make him move out of the apt you share.
You can ask your landlord if he has an apt empty that you can afford by yourself. Then you can move into it. But if your roommate wants to renew the lease that his name is on too, then the landlord can do that. Who gets the apt? Both of you or the one that stays behind. Seniority signatures has nothing to do with it. |

Probably not since he is contracted with you and the other roommate, and would not want to get sued for breach of contract. Likewise, unless the other roommate did something wrong, he probably won't just kick this other roommate out so you can live there alone. I would recommend talking to the roommate and getting them to leave or making the living conditions such that they would want to leave, then the land lord would probably be happy to sign a lease with anyone (you) so he has the place rented. |

How can you not live with your roommate if you're renting a room? Even if you don't sign the lease together, you'll still be living with him. |

When the lease expires, it is a done deal. What was on the previous lease is irrelevant. It is basically like starting over. Regarding WHO will sign the lease, it is completely the landlord's discretion- seniority really has nothing to do with it. It would be just like if you and your current roommate went to look at the apartment separately- it is the landlord's decision who to rent to. All you can do is ask. |

I'd say talk to your landlord about it now. More than likely you would have seniority and be chosen over your roommate but you have to ask the landlord. We can't tell you what he or she is going to do. |

If the lease is going to be up just let the landlord know that you want to renew the lease and your roommate is moving out. This is what I did when my roommate was leaving. |
