Will they take it all back with BANKRUPTCY?
I purchased furniture and jewelry with credit recently, but now our home is upside down and inside out and my husband's business is down the drain and will be sued by vendors. Can they take it all back? I know I can probably can affirm my car if I continue to make payments.

If you are filing a chapter 7, yes you can lose all this stuff. If you file a chapter 13 (and can afford the payments which it sounds like it is probably the case), you can keep it as long as you pay for all the secured debt (furniture, jewelry car) in full and get caught up on the house. If your business is incorporated and your husband didn't personally guarantee any of the debt I would recommend not filing a personal bankruptcy, but if he did personally guarantee the debt you really need to file. If your husband can get new employment in the mean time, a chapter 13 might be a good way for you to get back on your feet.

You need to consult with a bankruptcy attorney to look at your options.

if you are planning on declaring bankruptcy, you will have to pay for an purchases made in the last 6 months - they won't discharge those debts at all and you'll probably have to go on payments plan for all other credit cards/loans anyway - chap 13.

Make an appointment with a bankruptcy lawyer, they will tell you what to expect, do not listen to others, only a BK lawyer.

Bankruptcy laws are a lot stricker now. You'll probably be able to keep the stuff but you'll end up paying for it in the end.

Heres a rule of thumb. If you have no money, don't buy yourself expensive gifts

Yes, anything you bought on credit or loan can be repossessed if you don't pay it off, as can any assets the court deems "unnecessary." Even repossessed, though, the items would only count for their depreciated value, and you would still owe something for them.

However, don't always count on bankruptcy. The court is going to make you explore every other option first, including trading in your car for a smaller model with a smaller payment, lowering interest rates, and cutting other unnecessary expenses.

California bankruptcy law allows you to keep the property bought. Make certain that this is right before notifying the debtors. Some bankruptcy plans will give part of the pay back amount towards you debt and pay off what you owe.

I have been there and done that...It all depends on which bankruptsy you file under..for instance if you file chapter 13 you keep your stuff but the lawyer gets the payments dropped by getting the interest lowered. And you bills that don't have any colateral like, hospital bills and credit cards get almost wiped away. If you own your home you make a lower monthly payment and then pick it up again after the bankruptsy is over. Which is in about 5 yrs. That is really all I know about cause that's the one I filed you still pay your bills just at a lower interest rate. and all your credit card and hospital bills get pretty much wiped away. Hope that helps. :)

Yes, they can take away much, depending on the balance between what you owe and what you own. If the car is above a certain value (different in each state), it will be taken. Lawyers often give 1/2 hour free consultations... you can get all of your answers that quickly, some will do it on the phone. Good luck!

well in time like this even the banks they have problems,the only thing you can do speak to business owner from were you bought ,it maybe they can take there thins back ,but i am sure they will give you less money than the actual prices.wish you luck.
