We are currently renting a house from a friend that could not sell it. We moved in the middle of August, the house was not cleaned from the last tenants. The carpets were shampooed, but bathrooms & the kitchen were still dirty. We had been there for at least 3 weeks before they made an effort to have us sign a lease agreement, for 1 year starting Sept 1. We were the only two that signed, they didn’t & we still have not received a copy of the lease. There were still items throughout the house from the last tenants that the landlord kept saying they were going to clean out, & those items are still in the house. The landlord had called many times saying they personally need something from the house, or they were going to get the previous tenants items, cuz they wanted them back. The locks were never changed after the last tenants, so who knows who has a key. I would think that is against the safety the landlord has to follow? The landlord called my boyfriend over & over asking for the rest of the deposit, after we had already come to an agreement that we needed more time to come up with it. He came over 2 diff times 1 day, I didn’t answer cuz he did not give prior notice, he then went around the our garage door, opened it ½ way, with the garage door opener he kept saying he was going to give us, he looked to see if our car was there, then closed it. He said he was going to have the sprinkler system blown out for the winter, still hasn’t done it. I read that the landlord was not allowed on the property unless there was an emergency, or 24-48 hours notice. Him opening the garage door was deff wrong, but we did not know if him ringing the doorbell 2 times in 1 day was going against that since he came over without notice? There are many things wrong with this situation. We don’t know what can be considered breach of contract by the landlord. My boyfriend had the choice to lose his job, or transfer to Denver, obviously he is going to transfer, we told our landlords this, they replied at first saying they think we would only lose the deposit, nothing else. Later came back and said we were responsible for the rest of the lease or until they sold or rented it again. They terminated the tenants lease before us 2 or 3 months early cuz one out of the 3 girls moved out so the other 2 couldn’t make rent. He did not charge them for the rest of the rent, just took the deposit. This is no diff, but we didn’t know if they could do that to those girls, and make us continue paying. We have not missed or been late on any months rent, and we don’t bother them for anything. The front yard of the house is trashed, it has grass, lots of weeds and trash, same with the backyard, and we have a 3 year old who loves to be outside. also there were items left in the garage for the yard that my son could get into and hurt himself that belonged to the landlord. The window wells in the backyard were not covered. These are all things that are opinions of the resident of the house, but I would think would be considered safety violations when renting the property out to someone else. ? We have many problems with these landlords and need help, we want to know If any of these are considered them breaching the contract. I would put more about the contract itself, but I do not have it, they do. Please Help, we have to move on the 28th, and have to decide what we are going to do within the next week or 2. PLEASE HELP!!! Additional Details Those of you that think nothing is wrong with this you are completely wrong. go to an apartment and ask if they have to change the locks. safety is the responsibilty of the landlord. its pretty funny those of you that have already answered and think i am just making this up to get out without paying. I am renting a 3 bd 2 ba, 3 car garage, gorgeous house, and I would not be wanting to get out of this lease if I didn't truly have to cuz of the job change, or cuz the landlords are horrible. come on. O is it that you think I like going from place to place packing my 3 year old up and our entire house? ya right. I have researched about what a landlord is responseable for, and they have shown no responsibility for anything. |

Never mind breach of contract. The landlord (your friend, you say at the beginning?) has the signed lease and can legally hold you to it if he wants to TRY. If he only has a partial security deposit, he will need to come after you in small claims to recover the rest of the contract. Just move. If it ends up in small claims he will be confronted with your problems above. Take pictures just in case. Do not pay any more rent. And in the future, keep a copy of anything you sign. |

I did not see anything here that the landlord did wrong.
You misunderstand the 24 hour notice thing. He does not have to give ANY notice to come onto the property. The notice is to enter the house. He can certainly knock on the door anytime he likes, just like anyone else. |

Only a judge can decide if the landlord is in violation of the lease. The reasons you state do not seem to be an issue of "habitability". It's not a violation for the landlord to ring your door bell. He does not have to change the locks between tenants. All the other things should be addressed in your lease or discussed with the landlord prior to signing the lease. Sounds like your grasping a straws for a reason to move without paying. |

I can't see that the Landlord has done anything wrong here. As far as moving goes, he might be entitled to payment right through the end of the lease if he can't sell or re-rent the place. As far as the yard goes.... a few trash bags and a little work on your end could relieve the trash you say is all over the place, which leads me to ask.... why on Earth would you rent a place that's trashed? You say it's such a nice house leads me to question your motives here? Relocate to the new job and give up the deposit and pray to God he doesn't ask for the remainder of the lease. And why don't you have the rest of the deposit??? |

I do not know what state you are in but if you look up the Lanlord Tennant Laws for your state they will prob. answer your questions |

Each state has landlord/tenant laws available, most of them on line.
The fact that the landlord tried to open the garage door is a violation, but if its just your word against the landlords, the courts, unfortunately lean toward the property owners/landlords in situations like this.

I would love to help you but the fact is that laws regarding this matter differ from state to state. About the only advice I can give you is to see a lawyer. I'm so sorry that I can't help you more.

with all the hasstles you are currently having, i would advise you to find another house to live in and move out, You may loose your deposit but you have rights, take them up with your tennancy board and get them involved. |

Depending on hwat state, they have to give 24 hours notice befor they can enter the property, if you dont got the contract, you can probably do something aobut that too......most of that does sound like its dangerous, and not liveable, i would try a laywer if you want to take it that far, even if just to get their opinion |
