Green Arrow | Would rent be considered late if I mail check on the 3rd and the receive on 6th, if my due date is 5th? |
I will be mailing the check on this Friday the 3rd, and the receiver has a PO Box in the same post office i will be mailing from, so they should receive it on saturday the 4th. But lets say something goes wrong and I mail it on friday the 3rd and they dont get it until monday the 6th. Will I have a hard time fighting a late fee in that case? Additional Details Just as an update in my situation the lease doesnt state that rent is due on first but having a grace period, it simple says "Rent is due each month on the 5th." |

If the rent is NOT received on the "Due Date" as specified in your contract ; then it is considered LATE .... and Late fees CAN be added ....
NOTE: If your rent is actually due on the 1st before the grace period ; it is best to pay as soon as possible to the 1st ... as when you move, your new landlord will be inquring as to how you paid rent and if it was late etc ....
As a landlord myself ; I had a lady who was always late ... thus when the new apartment complex she wanted to move into called and I had to tell them she was always two or three days late ... she failed to get her new place . |

Yes, it will be late, but it depends on the landlord as to whether he charges you a late fee. If it becomes a habit then he probably will in the future even if he doesn't this time. |

Yes. Most landlords require that the rent be in their hands on the first of the month. Period. After that - for whatever reason - it's considered late.
My advice to renters is to plan on paying your rent earlier than the day they tell you is the last day. That way, if anything comes up that delays you making your payment, at least it won't be late. |

Yes, that would legally count as late. When it doubt, hand deliver it and get a receipt.
If you live in the same town it should be just as easy to hand deliver. |

I don't think you will have a hard time avoiding a late fee because I don't think you will be charged a late fee given the dates.
Consider the following:
"A provision such as this [late fee] is enforceable provided it is not disproportionate to the amount of harm caused to the landlord by the late receipt of the rent. For example, courts have not allowed a late fee of $50 to be imposed on a late monthly rent of $405, because the late fee was considered disproportionate and characterized as a penalty. The law does not allow a landlord to impose a penalty for late rent. The imposition of a late fee in rental units which are subject to regulation under the various rent control or rent regulation statutes may be subject to specific limitations."
In my opinion the landlord would have to justify that harm was caused as a result of receiving the check on the 6th. I can't see how he could since he would not be able to deposit the check until the first business day after the weekend which happens to be the 6th. I believe the courts would construe this as a penalty for late rent.
Just an aside. You said that your landlord has a box in the same post office as you. It doesn't matter. The mail still has to go through the usual sorting process before it ends up in his box.
Though "technically" the rent will not be in the hands of the landlord on the due date a reasonable person would factor in that the due date happens to fall on a weekend. I wouldn't worry. Others will not agree I'm sure. In future save yourself some anxiety and get the rent in a day or 2 before it's due. |

Yes, you will have a difficult time in defending yourself. Your rent, I assume, is due on the first of the month. That means it needs to be in the hands of the landlord on that date. I gather that your landlord has some sort of grace period. The grace period is intended to cover mailing delays and similar. You need to have MAILED and postmarked your rent by the first of the month in order to avoid late fees.
If you want to avoid late fees, pay your rents when they are due, and quit thinking that you have some sort of leeway in paying late. |
