I keep getting letters in the mail from my land lord mortgage company. We rent,They havent called wrote or sent an email or anything to me saying any different. Our rent was due the 1st and we have not paid it, and they have not called... or contacted us in any way...
I am thinking the the bank foreclosed on the land lord, and she defaulted on the morgage. Now I am scared that I am going to get screwed, pay them rent and then get slapped with a eviction notice and not have any money to move. I tried to contact them, and they wont respond. And I am scared if they do respond they will lie to get us to send them the money and then we will be screwed. I live in the state of florida any one know the tenant laws? I have 2 small children just got laid off from my job, and all the money i have is for the rent. What would you do? Save the money until you get a sure fire message saying that we can stay? Or just pay and hope for the best? I have heard horror stories o fthis happening before... any stories or suggestions? Additional Details also we were paying 1000 for rent but we talked them down to 800, and that was about 6 months ago, and she told us then that she wasnt even making enough to cover her mortage then... a friend of mine told me he paid his lang lord 6 months after his land lord already lost the house, and the bank slapped him with a 24 hours eviction notice the day after he paid rent and had no money and was screwed! scared help |

If you are getting letters in the mail most likely they are behind. Has anyone come to the house looking for them? That is a definate sign when they try to serve them papers. Open the letters you are getting to see what it says. You have rights too. If you find out they are in preforclosure stop paying and start looking for a new home. If they call and ask why you havent paid tell them you arent due to the fact you will be evicted soon. Give them 30 days once they call you asking. If they are losing the house they arent going to fight you for the back rent and give you any problems. They would be stupid too.
*edit* I was told by an attorney that the bank will give tenants a minimum of 2 weeks notice to get out. On primary residences they give people 30 days to evict why not tenants. You can request an extension when they come knocking if you havent found a home yet. If it gets auctioned off you can try and negotiate with the new owner also. A friend of mine was in that situation and ended up renting from the new owner. I am in Florida also |

I would contact the Florida Attorney General on what the laws are regarding tenants in a mortgaged property. They will be able to tell you what the course of action is or whether or not you can break the lease to move if the property is being foreclosed on...and you might want to call the mortgage company to see what they are doing, although they probably won't be able to legally tell you anything.
Slice is wrong, if the bank forecloses and gives a 24 hour eviction notice, you are screwed temporarily. Although you would be able to recover your losses in court at a later date (ie-prorated rent from the time of the eviction to the end of the month, as well as cost of temporary housing and moving). It is still a pain in the rear. If you do get a notice from the bank, you might be able to work out a temporary situation with them by showing them your lease agreement. They don't want the house trashed, so in order for you to leave it in good condition, they may allow you more time to move if you contact them. |

I would start looking for a new place to rent NOW! Keep your money, don't send it to her.
She's obviously either behind her mortgage payments, or the bank started foreclosure process. If the letters are a "Notice of Default" means they are going to start foreclosure if she doesn't bring her payments current which is unlikely. Each state has different laws regarding how long it takes to foreclose on a house.
Once the bank takes over the house, you will have only 3 days to leave.
Since you just got laid off your job, it will be difficult to find a new rental because most all require an employment check to make sure you can pay the rent.
Also, it doesn't make sense for her to reduce your rent if she's in financial trouble.

You don't say what the Mortgage Company Letters say...
If it is a Notice of Default... then that means your landlord is approx 3 months behind in her mortgage payment and will face foreclosure within the next 90 days.
If it is a foreclosure notice... then you should read carefully.
The date the property is auctioned on the court house steps
will be announced.
Get ready to move out of the property on or before the property is being sold at auction on the courthouse steps.
To stay any longer and keep paying your landlord would be what you are supposed to do... but at the same time no one protects you from being evicted 3 days after you paid the rent.
So... very, very frankly.... keep your rent money and consider your rental deposit gone. You will not see your security deposit so use it to pay the last rent. In other words don't pay the rent and get out as soon as possible. She will keep your security deposit and probably doesn't have a dime left of it.
Find the new rental as soon as possible and get out of this situation.
You owe it to your children to provide a safe and sane home. |

Don't pay the rent, at the same time do not spend that money, keep it and do not spend a cent from it. Save it, keep it safe, so if you get asked for it then you pay at once, if you asked why you were not paying just say you've been having some problems but you can pay at once.
Who knows, maybe you can live for some time with no problems and maybe even move having saved a lot of money. |

Go to the county clerks office and find out if the property is in foreclosure .
Yes , lots of renters are getting kicked out as landlords loose the foreclosure battle .
If the clerk says it is in foreclosure , ask the lender if they will accept rent directly and
Start looking for another place right away .

I don't understand why your landlord's mortgage company would be contacting you directly. Your rent should be paid to the landlord or property owner. You didn't mention what was mentioned in the letter. If you have doubts then I would contact the mortgage company and ask them if they could explain what is going on. I know someone who experienced something similar. She had a feeling that she should not pay her rent. A few days later she was given an eviction notice by the bank who foreclosed on the property owner. It would concern me to receive letters from the landlord's mortgage company. I would get everything in writing. You don't want to take a chance on losing your rent money. |

1. You have to pay the rent
2. If you know it is foreclosure you still have to, under current laws you can still be evicted even if he is not paying the mortgage.
3. Personally, I would save that rent money until they come a knocking for it, but don't spend it on anything else until you know for sure. - legally you should put it in escrow with the local court until the Landlord demands it.
4. Go looking for a new place, and once you are accepted use that saved money for the deposit and rent. |

Pay your rent. You have a deal. Whatever happens you will still be liable for your debts and people will come collecting it no matter what. You only risk your credit rating by trying to cheat your landlord.
If you're worried about being evicted, the best way to stop that is by paying your rent promptly. If you don't, then you can be evicted based on the terms of your lease. |

If I consume/use and have an agreement, NO MATTER what the other person did, I would uphold my end. If upholding my end left me short or in the dust that's the way I would be lesson learned.
