Would you take legal action against a family member?
My Father passed away several years ago, leaving property in another state (texas). This property belonged to his parents and was granted to all of the heirs, (my sister and I) after my Fathers death we became part of the property owners.

In 2004 my uncle, (1) of my Fathers remaining syblings, decided that he wanted to sale the property. Without our knowledge the property was sold, withing a years time, the new property owners had not received the title to the home, once the research was completed it was discovered that it was necessary to obtain my signature as well as my sisters. At this time my uncle contacted us, not explaining the situation, but forwarding the documents asking us to sign. I ignored his letters, wanting a face to face call. I never heard from him. I received a call today indicaing that he forged our signatures. Should I take legal action, or let it ride? (I have not heard from my uncle since 2004)

You should defnd your fathers Legacy, and fight for that Land and yes you should take Legal Action

First and foremost, talk to a real estate lawyer.

The buyer of the property,as suggested earlier, might also need to sue. Because of this, there can be issues with title.

If the title company KNEW the signature was forged, there might be cause to go after them also.

TALK TO AN ATTORNEY.

If my uncle did this to me i'd bring his *** to court.dont get me wrong, i do love my uncle and the rest of my family but i think yours may have gone to far and betrayed your trust and if someone in my family did that to me i would havve to evne though i'd feel bad sue them.

take him to the cleaners he didn't give two craps about the both of you he just wanted the money and the property should of stayed in the family not sold of for his personal gan so don't hesitate go and file the papers as the property does not rightfully belong to the new owners as your signatures have been forged that's forgery

What your Uncle did was illegal. He could face both civil and criminal prosecution for his actions.
You have the option to let it ride, but I know that I wouldn't and wouldn't blame you for going after what is rightfully yours.

Absolutely you should sue him. What he did was steal from you and your sister and committed fraud. He knew exactly what he was doing. You notice that he didn't try that stuff while your Dad was alive...he knew better than to even try. Just because he is a family member does not give him the right to do that. Please don't let him get away with it. God be with you

Unfortuneately, in this case I would. Consult a lawyer. He owes you and your sister for your portions of the sale, however, at the same time you and your sister probably owe for your shares of the property taxes.

Don't just go after your uncle. The sale of the property was unlawful. You still have a rightful claim to that property. It's unfortunate for the buyer, but the buyer may be the one who has to sue your uncle. Talk to a real estate lawyer in Texas to find out about re-establishing your claim to that property.

to me it depends on what u want to do. because he can have this case tide up in court for years and you have to decide is it worth it? what would your father want you to do?

and your uncle needs to be reported to the police. MOREOVER, the sale is void, the title company that did the search has insurance to compensate the buyer, so why do you want to be left holding the bag?
