Depends on the landlord.

If the landlord had to jump through major hoops to get you to pay up, then he may prefer a tenant that pays without fuss.

If you keep pushing the envelope on paying up, then the landlord might still want you out so that a less painful tenant can take your place.

doubtful, you must have missed more than one month rent to get an eviction notice. talk to your landlord about paying it and staying it is up to them, no matter what the responses on here are.

It is up to the landlord.

In most cases, no. You are so far behind, attourney fee's have been paid, etc.... you have already been given several chances.

Eviction is a last resort to a landlord... they MUCH rather have someone in the home that pays on time every month and takes care of the place.

All you can do is visit the landlord in person and beg for mercy.

I assume you are past-due for at least October and November.... if you go to him with at least those two months in rent, with a really good reason you were late, and an even better reason you wont be late again, he may let you stay.

Check with your landlord, but I would think they would send you a notice of intent to evict before they would actually go to the magistrate and file an eviction. What does the letter actually say!

Not necessarily. If you have been a PITA (pain in the a$$) tenant about paying rent on time, even if you pay up, he still may follow through with the eviction. Landlords want someone that will pay their rent on time, someone they dont have to chase down to get their rent. They have bills to pay also and that rent money goes towards some of it. So when you are late, more than likely he is late too.
In my apts, if you are late more than twice, you are out. I also have a $50 late fee and no grace period on rent. So pay me my rent BY the 1st and you are ok. Give it to me on the 2nd, you owe me an extra $50 and that is strike one.
Why you are late isnt the landlords problem either. Someone said to me that its people like me that makes a tenants life hard. Ha Ha. Guess what. There are no excuses for late rent. If you chose to help out a family member that had an emergency, knowing if you did so, your rent would be late, then honey, thats your fault. Your family member got into his/her own problem, but are you willing to risk your home to help them? Its not a shame to not be able to help them. Especially in this time of bad economy. You have to look out for your own self. You have to have a place to live. Landlords dont go on "feelings". Neither do credit cards. Its a business with NO feelings attached. Cant afford to or the landlord would be broke before you know it.

If this is a court order then no, you owe the money, and they can get it later by garishing your wages if need be (plus 10% interest if this happens).

If the landlord gave notice that he was evicting over rent then paying it and any late fees negates it IF it has not gone to trial yet.

It's up to the landlord. If he wants to proceed with the eviction he can choose to not accept your rent. However, usually if you show up in court with the rent, late fees, attorney fees & court costs...the judge will allow you to stay.

It depends on your state's landlord tenant laws.

In my state, I can accept past due rent and still proceed with the eviction.

Some states require the landlord to accept payment and the eviction will be stopped.

usually you get a 3 day or quit paper which means you have to pay within 3 days or forfeit the lease (break the lease & move out). Yes if you pay the rent within the 3 days the paper will be void.

Is the eviction from the court or the landlord?

If it's from the landlord, and they cashed the check, and you are FULLY up to date, yes, that stops it (unless you are month-to-month).

If it's from the court, it does not.
