Arms length transaction for what? You are a tenant with the option to purchase the home in the future. No laws broken.

Probably - the agreement up front to sell back to you may cross the line into non-arm's length and also possibly mortgage fraud. The bank is agreeing to write off a portion of a valid debt. You are accepting that agreement and the unspoken agreement is that you will not profit from the transaction that costs the bank money. If you purchase a different house, this is all moot - it is the buyback that the bank will have problems with. Of course, any purchase will be at least two years down the road since the short sale will pretty much harm your credit to the point that it will take 2 years at least to clean up. |
