Little Star | having problems with landlord not fixing broken shower and bath, what can i do? |
i live in a shared student house and our main bathrooms shower/bath has been broken for about 6 months now and nothing has been done about it, although we call them all the time the fob us off with excuses and say stuff like the plumber is getting the part etc. We are lucky there are 2 other bathrooms in the house with working showers but these are en-suite and its a pain in the mornings. We are going to tell the letting agency tomorrow that we are only going to pay half rent until its fixed, when it is fixed we will give them the remaining rent. We are gonna put the money in an account so it is there waiting to be paid in as soon as the problem is fixed. is this ok to do, legally etc? and is there anything else i we can do? someone told me that not paying rent is breaking our agreement, but the letting agency have broken theres by not fixing the problems around the house and its been more than 6 months... thanks to anyone who has any advice for me it would be much appreciated. |

Don't with-hold rent - that puts your landlord in a very strong position.
And as you have other bathrooms, it is not an emergency BUT the letting agent shouldn't be permitting this to go on. Get on at them! If they with-hold the rent, much better! |

Unfortunately, you can not withold rent. This could result in you being evicted under section 8 of the 1988 Housing Act.
Your landlord has an obligation to repair the bath under section 11 of the 1985 Landlord & Tenant Act.
If there are more than 4 let rooms, it should be licensed as a 'House in Multiple Occupation' by the council. Some councils requre smaller properties to be licensed too. The HMO officer at your local council may be able to make the landlord repair the bath etc.
You may also be able to get help from the Environmental Health Officer at the council.
