call the cops. did you sign a lease? you should have been given a copy when you signed. I would say pay your current rent. stay the next month rent free if they don't return your deposit and look else where. |

If you have not signed a lease, then in most cases ( check your state) You file a letter with the management company. File a written complaint with them about the noise and a 30 day notice that you are vacating the premise. Request a walk thru when you have cleaned it and take pictures. Request the return of the security deposit in writing. If not you have a basis to go to court. |

Have you tried speaking to the tenants on the floor above you and asked them to maybe quiet down? If you have and they've refused (And if the noise they're making is excessively loud and uncalled for) then I believe you're allowed to call the police for domestic disturbance of the peace or something to that matter. If the management company won't do anything to help you then tell them you're willing to take the matter into your own hands to settle things and it may place them in an unpleasant situation or you may be willing to file charges. If nothing else works, try buying earplugs or putting on some headphones and listening to some soothing music to help drown out the noise and help you sleep easier. Either that, or just move out and accept that there was nothing else you could do about it.
Though I do suggest speaking with the people who are making the racket first and trying to get them to quiet down at night so that you can sleep. Maybe explain the situation to them and politely ask that they either keep the noise to a minimum or at least limit it to times where you aren't trying to sleep or that you'll have to get someone else to settle the situation whether it means being fined or something else. Who knows, maybe they're disturbing other people as well? |

I lived in a very nice apartment and I had neighbors that would turn the music up so loud that it rattled the walls and the people above me would have parties all night and yell and bang. It was the worst year of my life. I complained to the office several times but they would just send a security officer over to tell them to turn it down. As soon as the officer left they would go right back at it. It really on caused bad relationships for me with them. I waited until my lease was up and moved out into a house. |

Landlord tenant law is governed by state law. In most states you are not bound if the apartment becomes uninhabitable and the landlord does not remedy the situation. However, if the landlord takes you to court it would be your responsibility to prove that the apartment was uninhabitable. Have you tried calling the police? Sometimes a visit from them is all that is needed to quiet a noisy neighbor. If this fails try ear plugs. They work quite well in most instances. |

i don, t know, but i would move away, and next time be very careful, and stay away from apartment buildings if you can, and stay away from the anything but the top floor, which is not a guarantee either, sorry to hear of your misfortune,please be more careful next time, maybe just leave and forget the security,but not everyone can forget money like that, but it would save you alot of time and money in legal costs or court time, just get up and leave, find another place, (i have lived in this horror, leave it, it will not change) notice why apartments are vacant when you look for your next place, houses too, be sure of what is around, good luck and peace |

if so, im fairly certain you can leave whenever (give notice and such, like 1 month) find a new place to live first,
if u havent damaged the apt. they have to give you your deposit back,

You can get a fan to help dull out the noise. Or there is a thing you can buy that makes white noise. You can also use earplugs. I used to take my broom handle and bang the ceiling to let my neighbors know they were bugging me too. If you feel really frisky you can get one of those big bouncy balls and bounce it up and down to let them know too. Or heck maybe just have a talk with your neighbors and let them know the noise bugs you and if they can try to be more quiet at night. |

Seriously, live there a month and leave. You won't be breaking the contract. Either the building has very little insulation and you can hear everything the people above do. Or...you have lousy upstairs neighbors. Either way, get out as soon as you can. Don't put up with this non needed crap. |

If it gets to loud, call the police. Otherwise bang on the cealing, but talk to them first. If you didn't get a contract, then there is something weird about the apartment building and you need to call the agency that checks thease buildings out. If you didn't have any contract for pay or the security deposit, you really need to call someone. That's not right. |
