The mortgage is between the owner and his mortgagee and you cannot obtain any information regarding payments and modification. I'm surprised that he even mentioned that to you unless he is giving you a heads up that the property may be in foreclosure in the near future. If foreclosure is filed you should have anywhere between 6 to 12 months before its completed. And, even then the federal Tenant Protection Act of 2009 will allow you to stay up to 90 days after the mortgagee acquires title. I recently learned that if it's a FNMA backed loan, FNMA will permit you to stay for up to one year.
