John | Am I liable if my employees get drunk and get arrested? |
I take very seriuosly the needs and desires of my employees. I take into consideration all of the comments I receive in the suggestion box. I noticed quite a few that wanted an open bar in the lunch room. So, at no small expense, I installed and stocked it. Not top shelf mind you but pretty good brands.
Now it seems they have taken to heart the warm camaraderie that lunch room now has. A bit much it seems. Four have been pulled over for DUI, the gate to the parking lot has been run down twice and somebody broke the copy machine by trying to make a copy of their......thing. And that was just this morning.
Not that any of that bothers me, I like a happy work environment, but I am concerned about my liability. |

I don't know where you are located but in Houston, you can be in trouble for that. If you are the one providing the liquor that they are getting drunk off of, then yes. You are reliable.
Here, you have to have a liquor license to have it in any establishment other than your home. Also, if you are serving it, you have to obtain you TABC license and you take full responsibilty of your customers to make sure that they aren't dunk and that they are mentally sane when serving them.
Every state is different though so you might want to specify your state. :) |

You've probably heard the old addage ... don't mix business with pleasure.
I'd stick to that. I can't think of any business that needs employees drinking on the job.
Your best bet is to put in something peopel will enjoy without getting themselves into a situation where they CAN'T perform the job you've hired them for.

just go and shoot ur self in any body part of yours u chose.
an open bar will get u arrested.
will get u to LOSE ur house car and ur business.
right now go out and pour every drop of alcohol down the drain NOW.
do not give it to any one , just down the drain.
put in company policy and in writing NO alcohol on premise or employee vehicles or the get FIRED.
u got a legal nightmare in the making. |

you have got to be kidding me. lol. omg. you totally made my day. I mean thats great if you are trying to keep your employees happy...i dont know what kind of business you have but i work at a hardware store and a few ppl have gotten fired for coming in intoxicated, another wasnt highlky intoxicated but he cut his arm open pretty bad. It doesnt sound like your work place will be very happy if more incidents happen like that. |

You might be if they cause damage, or hurt someone. You should talk to a lawyer, or whatever organization regulates alcohol to find out for sure. Different states have different laws, so without knowing where you live, you can't get a true answer from Y/A. I've heard that people in private homes have been held liable after a guest, that had too much to drink, had an accident on their way home from a party.
Having a open bar in your lunch room might be nice for your employees, but why would you want to have an "unlimited" open bar? Evidently some of your employees are not mature enough to control their selves when they have access to unlimited free alcohol, and are drinking way too much. Are they really productive employees after lunch time?
Being a nice boss is one thing, but risking your business, and financial future is not good.
Since some of your employees are taking advantage of you, you need to put a limit on the amount of alcohol they can have at a time, or better yet, close it down before someone gets hurt and you are taken to court. |
