An employee damages company truck, what should I do?
I have been running a small business for five years and am trying to grow it and make it a pleasant place to work. However, I had a driver who delivers for me rip the top of the truck off. I instructed (trained) the driver myself and specifically told him to watch out for items that the truck could run into. In fact, I told him to go around anything if in doubt. He has been with us for about 3 months with no previous problems. I don't expect him to pay for damages, but I wonder if I should have him pay for the deductable (or a portion) or if I should cut his pay, etc. To give a little more info, the action would not have happened had he paid attention and while I understand a business is responsible for its employees actions, where and how does an employee's personal responsibility work? I suppose I should ask how I should deal with this problem and how I should prevent it in the future. I have never had anything like this happen before and would appreciate the advice.

Unless it was "gross negligent" on the employee's part, you don't want to make him pay anything.....You can reprimand and suspend w/out pay, but if it was an accident, that is the unfortunate cost of business sometimes.

Also, based on your statement that damage was a real possibility that required the employee to make judgments as to "go around anything if in doubt"....well, that's just an unproven intangible...

Your employee might feel bad and agree to pay your deductible, but one conversation w/ a more enlightened friend, and he will discover that you were way out of line to charge him for a work related accident. Don't do it.

Reprimand, but not personally; be angry at the situation and not at the person. I would let him pay for half of the damage, IF his salary can do that. If not, then let him know you are not happy about the situation, but you will let him go this time, but not the second time around. Sometimes this builds employee loyalty, knowing he owe you one.

Well, a few items of note here.
1 - He cannot be held responsible for paying for the damages or the deductible. You cannot withhold his pay and you cannot dock it. Its the law.
2 - He has been employed with you for less than 3 months, which means that legally he can be released without any further notice or any further pay if you wish.
3 - An employees responsibility has nothing to do with an employers responsibility. They are totally different and separate. He knows by the nature of his job that he did something he shouldn't have done.

If he were my employee I would fire him post haste and cut my losses. There is little else that can be done. If you take any further actions beyond this (ie cutting his pay or physically/verbally abusing him) you will be only causing yourself more grief in an already bad situation.

most companies deduct so much a week out of the employees checks for the dedutable

this is very common. i hope your biz is incorporated. if an employee drives a red light and kills someone, you could have exposure.

you need to put a policy in place in regards to driver safety. i would put him on warning so he fully understands the seriousness of the issue.

i don't think you can legally make him pay the deductible but you may want to check with a small biz attorney.

it's very likely he wont make this mistake again.. If he's a good employee I would just give him a warning and maybe put him on a 90 day or 120 day probation.. But you might also want to check with your insurance company to see if they are OK with him still driving for you.. This accident and his driving record could raise your premium...

I guess make him pay for some it and forwarn future employee's if they damage a truck they must pay for the damages.
