Any Ebay experts? Faulty item dispute.?
I bought a rabbit hutch from a company on Ebay. It's not as described (different size), really poor quality, parts missing and generally not fit for purpose. The seller has said that they'll give me a full refund less p&p which isn't really fair when you take into account all the problems with the hutch. Also, I'm going to have to foot the bill to get the hutch back to them, it's going to cost me a fortune. Do I have a leg to stand on?

Check the original item description carefully. Check their returns policy. Even though the description may not be exactly right you will probably have to pay return postage. If it is wildly wrong then contact e-bay & explain everything. They should then step in and help you resolve the dispute. Good luck.

not really as on ebay sellers have their own refund policy

and unfortunately you will have to pay the postage

but at least you will get your money back for the hutch

it's really difficult, coz the powersellers know every trick to avoid giving u ur money back... I fear u just can talk to 'em or accept the situation, I hope it's not too expensive....

welp, if it says on the seller's website that they do not refund shipping, then i think you are out of luck; be sure to document everything, ie. all of your emails back and forth--try to only email within the ebay system. if it is REALLY not like described, then for sure you could ask ebay about it, but if they just said something like "used rabbit hutch" there might not be much you can do and you should be happy that you get a refund at all.

depends who sold it to you
if its a company then you have additional protection through the distnace selling legislation and sale of goods acts.

if its an individual then its much harder.. effectivrely your dispute is with anothe rindividual. I wouldnt rely on Ebay sorting it out for you....they are about as much use as a chocolate fireguard in my view.. all they care about is getting the fee from the customer who is the vendor not You the purchaser

if you paid by crfedit card either driectly or via Paypal then you have a much stronger case. refuse to pay the item when it appears on your credit card stastement. wrtie to your credit card provider know and refuse payment and state why. The one thing that will make Ebay listen is if they think they are going to loose cash.

if you paid by debit card then you are in a slightly weker position but its still worth refusign payment.

If they stated in the auction that they do not refund (most sellers won't) s & h, then no, you have no leg to stand on. But one thing you can do, that may not help your case but may help others and also may help get him the boot eventually, is complain to both ebay and paypal. Be as descriptive as possible. It will be a mark against him, the more people complain over time the more likely he will get kicked off ebay. And I'd still send the item back no matter what. Use Fed ex, they are cheaper

I think you will find thats standard ebay policy, and if you ran a dispute either through ebay or paypal they would say the same thing.
However a decent seller may refund p+p as well, as a measure of goodwill.

If you paid by paypal then you can can file a complaint to them who will take the full amount out of there paypal account and place it on hold till the case is resolved.

I had a problem involving something similar and although I had to post back the item using recorded delivery (for proof) I did get back the full amount i paid including the p&p.

If you paid via cheque then sorry but ebay cant do nothing there end. You have to sort it out between the both of you

You do have a leg to stand on -

1) The size is different than what is stated in the listing
2) All parts listed were not sent.

Down goes the leg if in the listing it states anything about not refunding shipping. But those 2 items should be enough to get ebay and/or paypal to allow you to dispute the transaction.

Complain to e-bay and insist the seller sends you a replacement item before you send yours back.
