Can an employer deny an employee breaks.?
I need to know because my boss told me NO breaks before 2 p.m. I start work at 8 a.m. This dude didn't even take my application before putting me to work in a 100 degree kitchen with no air. I'm thinking there has to be guidelines.

You'll have to read your state employment laws. I know in California they require breaks to be given.

Here's a link to the Department of Labor website.
Click on your state and you will see what is required.

PiggiePants
are you salaried or hourly? As rules differ from state to state, I recommend that you check on the Department of Labor section of your state's official website, and see what the rules are for your specific situation.

An employer is required to give you 1 [30] min. break per 8 hrs

bdancer222
It really depends on your state as the rules vary. But 8am to 2pm is only 6 hours and probably doesn't violate any laws.

Check with your local labor department. They'll know all the rules and regs.

John S
From my understanding, as long as you work over 6 hours you are supposed to get a break. That's supposed to be a law. But I don't know for a fact so that's just a rumor.

William
an emloyer is required to give employees 30 minutes of break time during an 8 hour shift. That isn't 30 minutes of paid time and I don't think it defines when. Logic tells you that it should be half way through the shift. However in your situation, the heavy work load probably ends at 2 and that's why it was set up as then.

Angie
Laws very by state. But I believe in most places the law is you must have a minimum 30 minute break after working 6 hours. So 8 a.m. to 2 p.m. does fall into that category.

For every 4 hrs worked.. there should be a 15 min break
as far as the heat.... nothing you can do about that.. look for something better

Fran J
if my memory serves me right and im a supervisor.your allowed a break after the first two or two and a half hours.a lunch after four hours and an after noon break two to two and a half hours after lunch. if you have longer days after every two to two and a half hours is another break.why didnt you fill out an application you could be screwed. you have no proof you work for this person. i would either fill out one or find a new job before you dont get paid and you have no proof of employment. allways have a application or some kind of contract. protect your self. you can allways call better the business beuro. good luck. oh allways read the fine print and if you do not understand something please never be afraid to ask.

Yes there are. You should have a break for every 4 hours worked. That means by 12:00 not 2pm. Check with your local Better business bureau. I got back payed for all my missed breaks at a carwash i used to work at.
