Can anyone help me with a problem I am having with a well known store. I have no receipt and they are refusing

Technically speaking...A sizing error is not their fault and they do not have to exchange the goods for you.....There is nothing wrong with the garment but you made the mistake picking the wrong size. The only time they are legally required to change the item is if it is faulty.
Most stores will change the size for you as a gesture of goodwill.

I'd have unpicked a few stitches around the hem or collar and said you noticed when you got home...then when you change it...pick up the bigger size.
If its a chain of stores...i'd go to another store and say the original store you purchased it from has none of those garments left and suggest another store...They recognise it's faulty and hoped this second store would have the garment in stock for a swap.

P.S... Trading standards will do nothing about you making a mistake as the store has legally done nothing wrong.....

If it isn't faulty and you can't prove you bought it there then they have the right to refuse you. You can ask to see the store manager and they are allowed to use their discretion. If you paid by credit/debit card that can be used as proof.

As you have no receipt, therefore proof of purchase from the store they are within their rights to refuse to accept return or to offfer a replacement

A larger size is a different bar code, so to give you the exchange they'd have to return the original. If you don't have a receipt, and the store labels are gone from the package, there is no guarentee that you bought it at that store, and what price you purchaced it at. I know its a pain, but there really isn't anything you can do about it

Unfortunately many stores suffer great losses from shoplifting and have strict policies in place. As far as they know, without a receipt or proof of purchase, you could have picked up the item in the store on the way to the customer service desk.

If you have proof of payment, that could greatly improve your chances of satisfaction. Go back to the store with your credit card statement or cancelled check, and ask to speak with the highest available manager, and see if that works.

if you paid by credit card, use that as a proof of reciept. otherwise go to their head office .another option if you have no luck is to sell it on ebay and go buy another elsewhere

They should exchange it for you - as customer service. I would ring head office. Have you spoken to the manager?

First of if it is something electronic most stores won't give exchanges or refunds without a receipt.
Second ALWAYS save your receipts.
I have some from 3 years ago.....
Because sometimes warrantys want the paid receipt........
........Third and most important.......
Contact the Better Business Bureau
If that store won't deal with you then put the black marks on their name for everyone to see.

Go up the chain...Take to the manager if they won't help ask for the District manager....If they won't help go to corporate if they won't help ...picket the store:)

Since you do mot have a receipt you cannot do anything much. You could though try and meet the store manager and sort out the problem.

The reply given by AMMO is a very good one and you should heed what she has said. However if you write to the head office or the manager of that store and explain the circumstances then they will probably do the exchange for you. If you could find some fault with the item then with or without the receipt they must give you the exchange or even a refund.

Well it does depend on what the item is. If it is underwear, swimwear, hoisery etc and you've tried it on and it's obvious that you've tried it on you are stuck with it due to hygiene reasons. If it's none of those items then they should just swap it for a bigger size! It's consumer rights (unless of course you've had it years!).

Did you ask to speak to the manager? If you've just been asking till people go tomorrow and ask again and if they say no just ask to speak to the manager or their supervisor. I've worked in shops before and have also had many dealings as a customer - drop me an email with more info if you fancy and we can discuss it?! =)

you are always wise to keep bags goods were put in as well as reciept If you can remember who served you it may be easier for you .If that dosnt help then you only alternitive is to write to there head office .

It is surprising that they are refusing to exchange although some to have a plaque up saying no receipt no refund.
Exchanges should still be allowed.
I would tell the shop that you are contacting trading standards. Also contact head office.

I'll tell you exactly what to do, but first dont worry, write to the Trading Standard Agency, keep a copy of the letter, then AFTER you send the letter to them, go to the shop where you purchased your item from and show them the letter.
No businesses like the Trading Standard Agency. Im sure the shop will change the size for you.
