i run a small dvd shop which is a franchise, but alot of people are lazy and wont return dvd's we have taking special mesures now but just the first ones that joined up,
i wrote a letter to infrom my customers if they do not return their dvds which cost us money and they cant just go away so they have the option a)return the dvd and pay up to 200 late rental fees or b) buy the dvd at less then 25.00
i wrote this letter which i will then hire a debt collector if they chose to ingnor this,does that sound reasonable or can i be sued???? |

You should write something like that but incoprate it to your Terms and Conditions to members.
So when they join your rental scheme that they read your terms and conditions and they sign it to become a member.
This then forms a contract between you and the members.
If they are then late returning dvd then you are within your right to impose those charges. |

You cannot simply change the conditions of your contract "just like that". You would have to let all your customers know and then perhaps say something like "if you continue to hire you will have been deemed to have accepted these conditions"
I am not sure what you mean by "200 late rental fees" If you mean that you will charge £200 this is likely to be seen as a "penalty" and unenforceable [this is what all the fuss of bank charges is].
As you are in business the CAB is not likely to help so you really do need a solicitor's advice.

I would imagine that the £200 fee is a bit steap. I thik the general rule is that they pay a late back fee until it reaches the market value of the dvd and then they have the option of buying it or returning it and paying the fee.
Normal circumstances is contact them by phone, followed by a letter, and then if still no joy, get a debt collector involved. |

I think it sounds very reasonable. My opinion is that you do it, and if after a year or two it is too much work you re-evaluate it. Most of the movie rental places do it. Yah, give it a shot. |

i have to agree with gavmel that you should write it into your T&C's, it will be hard for you to enforce it with current customers as you have not specified this will happen. obviously they have your items and so you have some rights to recover them. i think you could benefit from some legal advice, try contacting your local business link office - they should be able to point you in the right direction.
you can also get some advice from them on what would be fair to include in your T&C's to help stop it happening in the future - for ideas look at what your competitors do, and adapt their ideas to suit your needs. |

You must operate it the same as the video rentals did.
If the dvd is returned late, they should be charged the normal day rate for every day it is late.
By all means get a debt collector on the job, but will they work for such a small amount?
You must put up a messsage where it can be seen by the borrower.
Also, state that their name will go up on the `late returns list,` and shame them into doing so. |
