I think you can as long as you don't become an official business. My Grandma bakes cakes, cookies, and mexican sweets in her own kitchen and sells them to people. She packs them up and they can pick-up or she can deliver. It all goes around from word of mouth. She doesn't have a company name, logo, or anything like that though. So I think that's why it's okay for her. She lives in McAllen, TX, near the border.

You need to have a Special food license and it’s different in each state. The reason why they have this is because of health violations that could be caused. So you may need to also have a health inspector check out your kitchen.

Other posters have touched on each of the issues but
let me summarize.
1) Zoning laws limit operating a business from a home so you will have to get zoning approval.
2) You will need to get permission from the Health Department. Normally you would need a commercial kitchen that conforms to the health regulations before you can sell food to the public. I doubt you will be able to qualify using your home kitchen.
3) You will have to register as a business with the state so that you can collect sales tax.
4) You should get some liability protection, either setting up an LLC or a corporation AND get liability insurance. Without these protections a bad batch of potato salad that gets several people sick could lead to lawsuits that could lead to you losing your house and all your possessions.
As for the other posters Stunna is wrong. Just because your business isn't "official" doesn't mean it's OK. Her Grandmother is committing a crime that includes tax evasion. Tea B comparing a business to a child's lemon aid stand is of course ridiculous.

No i dont hink you can. Thats considered as a buisness. To do that you will have to get a sort of liscence. My grandma was once fined for being paid for sewing some her friends clothes.
