McDonald's and Burger King don't hold patents on the burger itself. They are not unique inventions.
What they have is a registered trademark on the names. You can't refer to your burger as a Big Mac or Whooper, etc. Nor can you use a name that is so similar as to confuse consumers into thinking they are getting a Big Mac or Whooper, for example a Big Mak.
If you really want to be successful, create a burger that has it's own identity that will make costumers choice your business over McDonald's. That is always better then imitation. |

As long as you don't call it a Big Mac or reference Big Mac or McDonalds in any way you'll be fine. They can't sue you if your burger tastes like a Big Mac or looks like one.
Lawyers are pretty sneaky though. I actually own a T-shirt company and I had a design that I named "Guitar Hero" and it had nothing really to do with the Guitar Hero game except for the name but a lawyer from the company that makes the game contacted me and told me I had to change the name.
These big companies will always give you a warning first before suing you :)

Of course you can. What you can't do is call it Big Mac or Mc Donalds (or probably Maccy D's!) Loads of burgers taste like that company's. The real question should be why on Earth would you want to? Their stuff - I can't call it food - is disgusting. |

There is no reason why you cant ...all you need is to use the same suppliers that they use( ie same burger patties) just couldn't market as a Big Mac(name Copyright protected)but they still might come you..but hopefully yours would taste better:) |
