Seven of Nine | Do I need to go legal with my tax? |
Hi I am a small business that only started up in April this year.
at what point should I declare it to the tax man.
I have used alot of the money I have made to buy materials and equipment. I have never had a start up grant all though I would like to know how to get one of those. I am very afraid the tax man will catch up with me but at what time of the years should I declare my business started to take off. What are the penalties. If I declare the last three months only will they find me out for the previous months. Alot of the jobs were cash in hand to. |

You should have registered as self employed within 3 months of starting your business, as others have said. There is a £100 penalty for not doing this, although a good accountant may be able to argue your way out of it. You do need to register TODAY!
You will be required to pay your class 2 NIC's by monthly direct debit and as you havn't been doing so, this is the reason for the fine.
You will complete a self assessment sometime after next April and if you submit it by 30 Sept 08, HMRC will calculate the tax due.
If you tell HMRC that you have only just started trading, what are you going to tell them you have been living on since April?
You need to have bomb-proof records - make sure all customers get an invoice (even if they pay cash) and that you put all your income and outgoings through a separate bank account, even cash should be banked.

Basically, you are supposed to declare the date that you started self employment within 3 months of starting.
Also, you are legally obligated to pay class 2 National Insurance contributions as a self employed person.
You need to keep receipts of everything you spent on your business, and proof of all the income you got from your business. That way, every year you can fill out a tax return.
If I was you I would choose a start date for your business, and ring them for advice-they can be really helpful if you are honest. And absolute horrors if you are not.
And dont mention the words 'cash in hand' to them, please.

You have to declare yourself self employed from the day you took on your first ever job. Not from when you start to make any money or 'take off'. If you don't do this within 3 months, of when you started, they will fine you.
I only took on one small job this summer and my expenses were greater than the money the job brought in but I still got penalised and told I should have declared it. You'll have to pay backdated N.I. from when you started too.
They will always catch up with you. Best to be upfront now and come clean rather than get yourself into a whole lot of trouble. If you're not straight with them now, they will watch you like a hawk in future and you'll end up with them on your back constantly. |

You need to file your return by April 15, 2008.
I suggest hiring a CPA to assist you. Ask people you know and trust for a reference.
There's a great deal that can work in your favor or against you.

This is too important an issue for you to stumble in the dark. Employ an accountant to do your 1st years returns and set yourself up up properly. You can then decide to continue with their services or not the following year.
Don't be afraid of the tax man, there are many ways to make your money work for you in a legal way.
Ok, so the tax man will always request money. Make sure that you are informed enough to avoid paying unnecessary amounts. Get as much literature as you can on small businesses, check out if your community does small business courses that you could attend and go into the tax office and arrange to meet a representative. They are not baying for your blood. They will help you.
Bottom line, don't make an enemy of the tax man. Be informed, be organised, pay an accountant and let it go so you can carry on with your new business.

I suggest that you contact the Revenue & customs and tell them that you are a sole trader and ask them to send you an annual return and also I suggest that you go to a chartered accountant and ask them to deal with the tax man on your behalf. |

I'd call H&R Block or a local tax office to really determine what to do. You don't want to go by somebody's answer on here and them be wrong and you end up sitting in the big house. I think it's only a certain amount of money to have to profit in order to file..BUT I am not 100% positive so I really advise you to call a local tax office and talk to them about it so they can give you a more informative and accurate answer.
