I want to do a purse with special things on it, and no one has it anywhere (and sorry don't want to give it out for fear of copycat) and was wondering do I HAVE to HAVE a patent, and license. It would be a purse for making life easiter and convenient. No special names, or trademarks or logos necessary.
I mean I don't have $7,000 to spend on a patent, and attorney and other etc......

You don't HAVE to HAVE a patent, but realize that if someone else sees your idea and THEY patent it, you may have to pay them a percentage of your profits. Basically, the patent owner is recognized as the owner of the idea, so you may end up just giving your idea away. |

Well if you don't, and it is a good idea then someone probably will steal it. That being said you can alway do what is known in literary circle as a poor man copywright. Basically the way this works is that you put your ideas, designs, and working models down on paper then you pack it all up into an envelope/box and mail it to yourself. When you recieve that box in the mail don't open it. You see once that box is sealed and has a postal seal on it is has become protected by fedral law, as long as the box/envelope remains sealed with the postmark visible you can prove when you had the idea. After you have done this if you wish to try to market your ideato companies for manufacturing can do so and if it is stolen you can sue the company who stole your idea. This is the easiest and cheapest way to protect your intellectual property |

A "purse with things on it" does not qualify for a patent as it is not a new idea. It might qualify for a design patent and certainly for copyright, but if you don't have $7,000 for a patent, you don't have enough money to defend the patent and probably don't have enough money to market the thing, but if you think you can make enough money selling the things to make you happy, then register the copyright, which is cheap and fly under the radar so the imitators don't start making it too soon and marketing with a lot more funds behind it. |

YOu dont have to have a pantent for Anything; but you have no rights to the design if you dont have a patent. That means that anyone can copy it and you can't do anything about it. And if they purchase a patent on it; you couldnt make it anymore. |

Patents only apply to secret inventions or processes.
Filing them means disclosing your invention/process.
That in turn means someone can copy with a small change.
Which leaves you having to sue & press for licensing.
What you can do is file a copyright on your design.
This could be as simple as sending by registered post.
Send to yourself & don't open it until you have a case. |

Unfortunately in the unscrupulous world of inventions and patenting infringement it would be highly advantageous for you to secure patent rights. You will want to have protection against the copying of your item but even then you will have a hard time keeping it your own. It's like Knock-off purses and watches that are just there and no one does anything about it. Once your idea is out there is open hunting season. |

uhh, well if you dont then someone WILL copy your idea and get a patent befor you. I fyou want credit for you hard work, and if you think you will get a good profit out of it, then it's worth getting a loan or something for that patent. p.s.- everyone loves purses, i sell SO many of them at the clothing store i work at. If you think you have a good thing going for you and others, go for it!! |
