i sold a playstation 2 on ebay last week. my wife and i double checked to make sure everything worked before shipping it, now the buyer "claims" it doesn't work and wants a full refund plus shipping costs. we did not offer returns when listing the item. do we have to do this??? i believe he is responsible for the damage and now wants us to pay for it. can they take money out of our paypal account w/o permission? thanks |

Judging from your question, the buyer has received the PS2 but claims it is not working. Did the buyer say it was damaged in shipping? Was the shipping box damaged? Did you do a good job packing it?
If it was indeed damaged during shipping and the package was not insured, then technically, you don't have to refund the money. Of course, if it was insured, then have the buyer file a claim against the shipper.
If the buyer does file a claim with paypal, there is a chance that paypal will side with the buyer and take money from your account. Was the transaction covered by paypal's seller protection program?
In most cases, if the buyer has received the item, paypal will not get involved. However, if the buyer paid using a credit card, he can call his credit card company and reverse the charge. If this happens and you are not covered by paypal's seller protection policy, paypal will take the money out of your account. There is nothing you can do about it in this case.
All else being said, shipping charges are not refundable. Unless you offer to reimburse the shipping charges, he has to pay for shipping it back to you too.

They can try to make a claim against PayPal.
If you did not offer returns, and you sent it to a confirmed paypal address, you should be OK.... but answer all questions from PayPal quickly, and do your best to protect yourself.
Do you have the serial number of the PS2 you sent him? |

okay, you don't have to refund the money if you don't want to. you are not responsible for damage caused by mail. if you purchased insurance when mailing the item you might be able to get them to pay you back, and use that to pay back your buyer.
the buyer can file a complaint with paypal, in which you and the buyer will comunicate via paypal, so that comunication is monitered. pay pal will then investigate the buyers claim if them feel that you are at fault they will request that the buyer send the item back to you and once paypal have recived proof of postage they will refund the buyer his money.
my advice would be that next time get your package insured before mailing. |

Tell him to get a guy that works at Eb games or game stop to sand you an e-mail confirming that the system is broken. If he cant do that, he s lying. And don't fall for "there are no game areas around me" if he really wants his money back, hell make the drive |

Yes, they can make a "paypal claim" and Paypal will decide who is right. In the future you should always insure your shippments, and mark your acutions as "as is". an you should track the item! This will keep you from getting in trouble. |

If you don't have delivery confirmation you are done. All I can say is it's best to get it back then for them to keep it and get their money back. It can happen real fast. It's not your fault at all, but that is how it is. My seller id is terranovaandco. Email me for any concerns and with the item number. If you listed the item as is, and no returns, Ebay will honor that.
Go to Ebay, their job is to settle these claims like you have.
You have the photos of your product like you listed it on Ebay, they will no doubt have theirs, but you also have your as is sellers listing saying that it is working. The bidder accepts all responsibilities when they bid on it and win it.
Go to Ebay, they are your friend in this case......They are very seller friendly. |

If you don't list returns then you should not be responsible. Ebay is big on refunds for items that DO NOT ARRIVE, but not if they are delivered.
Do you have any proof that the item was delivered, just to be safe?
Also, if it were me, I'd transfer the funds from PayPal to your checking account. If you know you're did the right thing by shipping a working item, then you should not be penalized.
Assuming, of course, that you packaged the item properly. |
