Employee termination protocol: Do we have the right to deduct from his paycheck?
A friend of mine owns a small business located in a skyrise. He was not available to personally fire the employee but he reported her to security and told security that the employee was no longer allowed in his office and to collect the keys from the employee. When the employee showed up, the person was unable to go up but did not relinquish the keys stating the he would not do so until he received the pay check. Do we have the right to deduct the fee for lock and key replacement from his paycheck?

sorry you can not because when you fire someone you must have their final paycheck in hand and give it to them......try to contact this person and make a appointment for exchange of keys and paycheck...........

And your friends reasoning is faulty. The employee could have handed that one key over and still have had a bag full of duplicates in their car.

If a lock needs to be changed for security reasons, fine. But don't try and palm off the cost to other people.

The answer is no. You can hold the paycheck until the keys are relinquished but you can't automatically assume that he's going to keep the keys. Hopefully they are keys which can not be made without special authorization...and they should say "do not duplicate" on them. If all the former employee is asking for is his check prior to turning over the keys...then give him the paycheck and get the keys...that simple.

i think the employee was not accorded due process here. even if an employer thinks the employee deserves to be terminated, there must have been due process, that is, she must have been informed why she would be terminated and when. good for your friend if the employee would not file a case about this.

to answer your question, no, you do not have the right to deduct any from her paycheck. any deduction from employee's paychecks should have the authorization of the employee concerned.

the best way to approach this is to talk directly to the employee and explain to her the situation. but she still has the right to file a case or seek redress for her situation.

PERHAPS BUT WHY BE PENNY ANTI.
HAD SECURITY DO WHAT A MANAGER SHOULD HAVE DONE IS A CHICKEN DEAL. I'D BE GRACEFUL ENOUGH TO
SEND CHECK EXPRESS MAIL. PAY FOR LOCK CHANGE AND PONDER WHY I AM SUCH A LOUSY PERSON TO DISRESPECT ONE IN THIS MANNER.

SHE DESERVES BETTER TREATMENT EVEN IF SHE DESERVED TERMINATION.
