How can a small comany get money back its owed?
I'm working for a small video games developer and they have outsourced me to a slightly larger games developer, however the larger developer is failing to pay the smaller developer and running us (the smaller developer) around in circles with such gems as "the cheque's in the post" which is total bull-crap. Anyone know how we can force the bigger developer to pay us? Are there laws for this kinda thing?

The problem is that we never signed a contract, the boss of my company said that he was sorting all the payment stuff then complained to me when I didn't get a contract :(

We did ask them for a contract (we have emails to prove it) but we never got one, so do we even have a leg to stand on?

essentially there not a lot you can do in the short term

yes you can go legal, they could probably spin out the delays even further, after all they don't want to pay until the case is heard, and they will probably magically pay the day before the court case is due to be heard.

you can threaten to withdraw your labour until they make contractual payments, if you do, then depending on the amount owed they may counter sue claiming your failure to deliver meant the project folded is late or whatever.

Depending where you are you may be able to to force some form of interest penalty on late payment, you can inthe UK, but I think you need to expressly state the terms prior to issuing the invoice.

But that still doesn't force the customer to make a payment.

Usually the only sanction is to go nuclear, inform the customer that unless you are paid as per contract then they do not have the rights to any work done by you or your company, but the success of that depends on the contract between the two companies, the element of how critical your work to them is.

I suspect that they effectively are trying to coerce you to leave, without payment and then see if you are going to come gunning for them If the work is largely complete Im sure its late payment games, if its still ongoing and there is a lot to complete then it may well be financial problems.

If you have decided that you no longer expect to get any work from that company, and that they are a potential basket case or never going to pay up, and the amount is large enough consider going to court, make statemtn of affairs and get a judgement against the company. effectively if thewy are short of money and about to go down the tube you can get prior rights to payment amongst other creditors. I forget what the correct legal term (Statutory notice comes to mind) is but effectively you assert your rights in court and they must pay by a certain date (usually 28 days), after which you can if you decide start proceedings to wind up the company. you can also add costs for debt chasing, interest from the moment you deploy the notice....... get some legal advice

A Lesson to be learnt - many people think that it is better to do business with large companies because of the security of getting paid and them not going bust.

Wrong! Large businesses don't make money by paying what the owe on time. And they can be the sole cause of small businesses going under.

Your loyalty to your company is sweet if you can afford to wait... the best options are if you are still working at the company to try and speak to someone in the finance depart... friends usually scratch each others back so to speak... other than that it is to play the waiting game and not even the sight of a solicitors letter or a court summons will make the larger company blink twice.

The bigger the company the less sense of responsibility and accountability individuals will have....

i have a small business and occassionally i need to chase in money from customers. I use a company called Thomas Higgins and Co who are solicitors that are based in UK.
You can register online and they will send a letter requiring payment within 7 days they charge £2 per letter. 7 days later they will contact you if you have not received payment they will swiftly take action on your behalf in county court if required. They also deal with late payment charges where you can charge interest and compensation legally if a customer breaks your credit terms again their is only initially a small fee for this. They have a simple list of charges and I have found 1 letter from them usually does the trick. hope this helps. good luck. google their name to find them on web.

It is now so easy to take someone or a company to court that you can even do it on line without having to go to court. Google UK small claims online

Its down to the smaller company to pay you if you are employed by them, whoever you done the deal with is the identity thsat pays.

The larger company is not your problem. write via a solicitor to your employeer stating they are not paying you and to honour now your wages otherwise you will consider aplying to the court, courts can also register a ccj against a company which is something they will wish to avoid.

Whether there are laws for the kinda thing depends on what country you live in and what the legal system entails.

I would expect that the two video companies have a contract that stipulates payment methods. If that is the case, the terms of the contract are legally binding. However, enforcing it is another thing. The smaller company would have to initiate a court action, perhaps in Small Claims Court, depending on the amount. If the judge rules in their favor, the ruling means the small company then has the legal right to take action to collect the money. The onus is still on them.

The sad truth is that the bigger company can probably afford to hire lawyers and incurr legal expenses, which may be out of reach for the smaller company. Sometimes it seems that contracts are only helpful if you have the resources to enforce them.

As for forcing in other ways -- nothing that's legal! :-)

Do you have a contract for services with this company? If so, they are probably in a breach of contract with you. I'd first send them a certified letter, return receipt requested (are you in the US or UK? Maybe it's different in the UK). You can as a next resort hire a collection company to assist you in collections. Last resort, I'd take them to small claims court depending on the amount they owe you. If it's too much for SCC, I'd hire an attorney to represent you.
