Although no limited company may have the same name as another, the names of unincorporated companies are no longer regulated. (Years ago, one had to register any business name, but not now) Therefore, if you are a sole trader or partnership, you can call yourslef anything. |

In Canada there is a Business Registery but it costs U $75 for the search. It's cheaper just go to the Revenue Office and they'll do a search
for less money! That's what I did. My business
is Dollardays Plus ( I wanted Dollar Days but that was taken!) I only spent $35 including GST
for search. Note In Canada U can not have a business the same name as another no matter what Industry you're in! If U call U yourself Savers 4 all and there's another called Savors for all. they are not the same name cause they are spelled different!
If you're in the U.S.A see if the tax service there does business searches! |

By conducting a search of that business name at the business names registry and confirming that the business is a going concern from the returns and if not confirm the period when the name would be struck off the register in order to register your interest(ie that business name as yours). |

do a copyright or trademark search. if there is a business with the same name and its registered it will show. if it's not registered then copyright or trademark the name yourself. |

However - I understand that you are able to have the same name as someone else... as long as you will not be competing with them and you are in a different industry. |
