It is a very complicated area of law. You will have to do a search in your state and also put an ad in a local business paper or newspaper.
The main issue is whether or not you will get caught. For example, in our area there was a diner called the Lexus Diner. It has been in business for 40 years when Toyota launched the Lexus line of cars. Toyota sued - successfully - to make the diner change their name because Toyota had a valid trademark and the restuarant had never filed. However, if you name your place the Market Street Cafe and there is another Market Street Cafe in the next state or even in the same state but not too close to you, they may never find out and, therefore, never sue you to change it.
BTW, Market Street Cafe is a good name, especially if you are on Market Street. How about "It's DeLuvly" like in the old song?
Anyhoo, you need a local lawyer to help out. Budget $500 - $1000 or so. Good luck. |

You can't name it something someone else is using if it's the same type of restaurant. McDonalds for example, would sue you if you named a hamburger place, McDonalds, but if your last name was McDonald, and you had McDonalds Home Cooked Meals, you might be alright. |

There may be some differences in your area, but basically just...
Go to your county hall of records. They'll have the tools for you to do a business name search to be certain no one else is doing business under your chosen name.
Then file your business name and publish an FBN (ficticious business name) Statement in a local paper per the required guidelines.
If the other, out-of-state businesses don't do business in your state (and thus don't have an FBN filed) there isn't any legal concern about duplicating names. The only thing is you don't want to choose a name that will negatively connect you with another business. |

dpends if other restaurant has copy right laws attached. Maybe ask your local council about the laws in your town regarding copyright but as far as i kno thre are many restaraunts with identical names. Maybe try spelling the name of the other resaurat differently!!! :) |

Probably be ok if as you say there are no other local resturants you could get confused with and you're not trying to name it after a major chain of them (So don't try calling it McDonalds Food Emporium!) |

It is legal to have the same name as another resaurant, inside or outside of your state, as long as the other resaurant is not a chain. Hence the hundreds upon hundreds of independant resteraunts named "Restaurant." My advice is: If it has a trademark, don't go there. Most states have online databases where you can check all of the registered business names in your state. In addition, your state will probably allow you to reserve your business’s name for a small fee (usually $10 to $20). This is nice if you have a name for your resaurant, but aren't sure you are going to open it. Good luck in your endeavours, hope that was some help. :D |
