Moreover, there are different protections for a product (a trademark) versus for a service (a servicemark).

Further, the US Patent & Trademark Office should be able to explain costs and fees associated with their different federal registrations. 1. Ensure that the name does not resemble the name of any other company already registered.
2. Apply to the concerned ROC(Registrar of Companies) to ascertain the availability of name in Form-1 A along with a fee of Rs.500/-. If proposed name is not available apply for a fresh name on the same application.
3. Drafting of the Memorandum and Articles of Association, vetting of the same by ROC and printing of the same.
4. Stamping of the Memorandum and Articles with the appropriate stamp duty.
5. Get the Memorandum and Articles signed by atleast two subscribers in his own hand, his father's name, occupation, address and the number of shares subscribed for and witnessed by atleast one person.
6. Get the following forms duly filled up and signed:-
» Declaration of compliance - Form-1
» Notice of situation of registered office of the company - Form-18.
» Particulars of Director, Manager or Secretary - Form-32.
7. Present the following documents with ROC with filing fee and registration fee:-
i Declaration of compliance - Form-1
ii Form-1, 18 & 32 in duplicate.
Name availability letter issued by ROC.
iii Power of Attorney from the subscribers in favour of any person for making corrections on their behalf in the documents and papers filed for registration.
8. Obtain Certificate of Incorporation from ROC. |

you dont trademark a business, you incorporate it. you trademark an idea or a product.
i think what you're looking for is how to incorporate your business so you're not held liable if someone sues you (they can't take your house or personal possessions)...also so that no one can steal your business name and it become more legit - ie: you can get an EIN number that will allow you to qualify for business loans, etc. |

Find the best attorney you can and be prepared to pay and wait. Paperwork is not bad just about 6 months if there are no discrepancies with another similar business. Cost now is around $7,000.00. I paid $6,000.00 3 years ago.

Good goddess... I can't believe all the wrong answers and bad information on these posts.
Trademarks have nothing to do with the SEC, or the Department of Commerce. CPA's are definitely NOT trained and qualified to do this kind of work. Yes you could hire a lawyer, but if you are a small business owner you do not need to pay an attorney thousands of dollars to register a simple word or logomark, you can do it yourself.
Start reading: http://www.uspto.gov. Also, if you are near a large city, go find your local United States Small Business Administration (SBA) office. They have counselors and references that can help you get started on this. Trademark registrations are not difficult, and the USPTO is one of the most user-friendly government agencies around. |

Contact the US Patent and Trade Mark Office. They have a website and there you will find a phone number that you can call and they will send you a large packet of information and forms. It is not hard. Use Yahoo Search USPTO.GOV or Key Word, " Patent " |

There is a lot of inaccurate information ion t here. You do not trademark your business - you trademark a name of a product or service you provide, or a logo. It is the mark that identifies your trade. The mark has to be unique - you cannot trademark a common word or a general description of your product. The logo must not be similar to other logos.
The process is not too complicated or expensive (at least in Australia). It can be done on-line. |

I don't believe you get a business trademarked. I think you get a symbol or a logo or an advertising item trademarked, something that you want no one to be able to use like you use. For example, a can of coke will have Coca-Cola on it with a trademark or registered trademark symbol. You can say Coca-Cola but you can't use the name for advertising or put it on one of your drink products.
Do you mean you want a business incorporated? It's not very much $. There are some paperwork items to work through. |

Your C.P.A. (Certified Public Accountant) will be able to get this done for you, and the cost of doing this will depend on the size of your business. I am a Sole Proprietor and trademarking my business name is not necessary, but if I should ever want to, my accountant said that he would make me an "S Corp" (which would include the trademarking of my business name) for about $650.00. He also said that my business isn't large enough yet to consider it, so I should wait until I have more employees and earn more money. The benefits definitely are worth it...more write offs (such as vacations, employees moving expenses, etc...) |
