I am a small business owner & a client is late 4 months. He keeps requesting extensions how do I handle this?
He was my first client and his bill only came to $215. I gave him his bill 09/01/08. As of today he has not paid claiming he is waiting for an insurance company to pay him. Hes a chiropractor. I sent him a certified letter in which he called me apologetically asking for just a few more weeks. Well it's been 14 days now & still no payment. He's a little arrogant about the payment making it seem like he should be able to pay whenever he feels like it. I'm struggling between just writing it off even though he'll think he's got one over on me & pursing collections. Since he was my 1st client I didn't have an agreement or contract signed. I am a virtual assistant and I just did his customer service for a few days. What should I do?

Write a return receipt requested and send a copy without the rrr letter and tell him that you have been overly generous in awaiting his payment but if it is not been paid in 10 days you will file a small claims case then DO IT.

I too am a small business person.

Here is how I would handle it. If he would have been up front in the beginning, I would have worked something out with him charging a service fee for each month it takes to get paid.

He waited until you had to send him a certified letter. At his point he thinks that you have to wait for him to come up with the money. I am not his business partner and he doesn't send me extra money when he is doing well. I should have to wait when he isn't doing so well. He agreed to pay you a certain amount for the services you provided.

At this point, I don't care about keeping him as a customer as he'll probably pull the same thing next time. I would file in small claims court. If your invoice has something about late charges on unpaid balances, I'd include the late charges as well.

Sue him for services rendered. Sentimentality will turn him into your last client if you aren't careful. Try to work out some payment schedule to at least get him started paying. At 90 days I'd have called Vinney.

well, you're kind of screwed since you didnt have an agreement or contract. havent you learned anything from Judge Judy? never do anything without some type of agreement in black & white. or pink or greeen depending on what color ink you use.

call him at his office. he would want payment for his services. if that does not work try showing up at his office. you could also call him at home.take him to small claims court.

Tell him that his insurance problems are his own. He is responsible to pay you in a timely manner and its his own responsibility to deal with any insurance company that might reimburse him for the expense.

I would give him a final notice and give him a date upon which you will turn the debt over to a collection's agency. You'll probably only get $50-$100 for the debt, but you shouldn't give up what you can get just because this guy is a jerk.

Verbal agreements can still qualify as a business agreement. I would keep everything he sends you/ you send him as well as document any correspondance you have with him in detail. Then, I would sue him in small claims court. He is basically stealing from you. I think you have been completely reasonable.

First, send him another letter than explains all dates involved, then ask that all correspondance be done in writing. Give him 30 more days to make a good faith payment, even set up a payment plan for him, i.e. $50 per weeek still it's paid off or something.

If that all doesn't work, take him to court. Even if it's only $215, you don't want to let other companies think they can do the same to you.

Lesson learned. Always have a contract concerning collections and the process of collecting the money. If you can make it without his money then keep moving forward. Never do business with him again. Send him one more letter and then send it to a collection agency. I wouldn't waste too much energy on it. I was a huge lesson learned for only $200.

Your mistake was in not getting a contract. However, if you do have any documents showing him acknowledging the debt and asking for more time to pay it you need to keep that as evidence.

If you have such evidence, then sue him in order to get a court order that you can try to enforce.

If you don't, send him a letter telling him that he either needs to pay in full by a specific date or send you a schedule for making the payments. If you're lucky he'll send you something in writing acknowledging the debt. If not - you're screwed - consider it a $215 education and refuse to work for him again.

get a solicitor to write a firm letter then its a small claims court do not let this go

Tell him you will turn him to collections if he doesn't start making an effort to pay. Tell him 21.50 every other week - he will be paid off by spring time.
