everything and I mean everything including the role each will play and who is the boss must be in writing and notarized what percentage of the buisness is your and that other party just decide this now before the deal signing and put it in writing as a contract and then if you people can still be in the same room without killing eachother then go for it!!!!! |

You can go into business with a family member but be prepared to lose the relationship if things go south. Before you sign anything, get a separate lawyer. Make sure you understand what you are signing, what you are putting into the business and what you expect to get out of it. Make sure you are truly interested in the business. |

You should both have a goal in mind for the business - from opening day to the end of the first year, 5th year, 10th year. You should have, in writing, what each persons responsibilities are, what each persons spending budget is for certain divisions - materials, packing, advertising, kitchen, office materials, vehicle maintenance and insurance, employees, etc., how much each person put up to start the company, percentage of ownership, who, what, how, when and where any hiring will take place, firm rules on how things are decided on for the business, if you ever have plans to go public with shares, if it takes on or both of you to sign a check if it is over a certain amount of money, what company credit cards can be used for and what the limit is on daily spending, set realistic salaries to start and review these with your P & L's at the end of each year to make needed adjustments, how vacations are to be worked out, just everything you can think of should be on paper and agreed upon before a contract or a corporation is made. Not all family businesses are bad, most are a wonderful thing and work well for all concerned. Each of you should make a list of what you expect and then get together and go over them together so you can get a really great start to what each of you is looking at for a successful business venture together! Wake up. No matter how good, how well, how much money, planning, etc you do. It will fail. Its why its such a LOUD rule in business.
I thought I could go against it due to the fact my partner was a best friend of 17 yrs and not "family". Doesn't matter. Bombed hardcore and I don't have that friendship.
So unless you want to mess up your life, business life, finances, family life and peace. Then go ahead. If you care to learn a lesson from thousands upon millions of others who created that rule. Don't go into business with friends or family.
At most... you are the owner and you hire them as an employee only. Or they open it and hire you. Once ownership happens on both sides, war starts. And it will be the ugliest divorce you have gone through. |
