Sara sells cakes and homemade desserts. She decides to use her kitchen as her offfice in order to claim her kitchen space as a business expense. In order for the IRS to allow this deduction, Sara will have to_____?

A. Keep a log of all her supplies.
B. Use the kitchen only for business purposes.
C. remodel the kitchen.
D. Occasionally use the kitchen for business purposes.

From the IRS website http://www.irs.gov/pub/irs-pdf/p587.pdf business use of home can only be deducted if the area is EXCLUSIVELY used for business. The kitchen therefore to qualify for home business deduction must be used exclusively for baking these cakes and homemade desserts. If this area is used for personal purposes -- cooking meals for the family -- Sara can run afoul of the IRS rules and will not be allowed to claim that area as a business deduction

The answer is D. This is why:

1(A). It can't be "A" because the IRS isn't concerned about her supplies (maybe the Health Dept would be)...although they would need copies of receipts given out to customers as proof of an actual business...and receipts of whatever she is spending for the kitchen (not the supplies themselves, but the money she put into it).

2(B). She doesn't need to use it only for business. It can be a deduction any time she uses it for business. They don't care what else she uses it for...as long as she has the proof she needs for the time she does spend in there for business.

3(C). The IRS will only let you deduct the costs used to adequately maintain your business. So if her kitchen works fine for the cakes and homemade desserts before she starts, then she better just stick with "the simplified way". In other words, not to remodel the whole kitchen.

4(D). As stated in "2", as long as it's occasionally used for business purposes, Sara would only need to supply the information for the times that it is used for business. So, if she typically uses it 3 days a week for business, but one month she ends up using it 4 days a week for business, then that's what she would claim. The other 4 days a week (and 3 days during that one month) would just not be claimed. See what I mean? She would turn in the receipts for those days only that she used it for business. Even if she only got 1 customer, it would still be a write-off.

I would say "A" also because anything used for preparing home meals would be disallowed.

What a question to ask. She would have had to have her entire kitchen checked out by the Health Department and get some kind of license also before using her kitchen for business purposes. A friend of mine made candy in her home and went through a lot getting the business set up and approved.
