we must be missing something, what is he taking you to court for exactly. did you sack him for giving you no notice of his holiday because if you did you are within your rights unless he had been working for more than 6 months and you did not allocate him any paid holiday, if so he has a case. |

To cover your a**, make sure you document the days of work he missed and put that in his file. I would recommend sending him a letter at home that he has been terminated for absenteeism. |

He can't take you to court as he left his job.. effectivly left without notice, only two weeks later wanted his job back.. There would of been no need to fire him because he ceased to work for you the moment he left.
I would of course take some legal advice, but really I doubt you have anything to worry about.. in fact he must be pretty cheeky to even ask for his job back... or stupid! |

You didn't say what he is thinking of taking you to court for, but I am going to assume you fired him and that is why. That being said if he gave no notice and just went on vacation for two weeks then he has NO legal ground to stand on. If he has any brains about him he will not take you to court, and if he does then you will be fine, there is nothing he can get you for. Assuming there isn't anything more to the story. |

Josiejum makes a good point. How do you know he went on holiday? Was it like, "Ummm, yeah, we haven't seen in you in a few days and we're gonna need you to come on in, so ummm, are you going to come in today?" Employee replies, "I'm going to Disney World!" (very American dialogue but it works nonetheless), or was it a case of his leaving work, not coming in for two weeks and your assuming he was on the beach when he was ill? If that's the case, he might have a case. Of course, if you're in Britain (are you?), your laws will differ from those in the States and you should consult your solicitor.

Its depends how long he has been working for you for. Less than two years you can sack him for scrathcing his @ss and court won't care. If its longer than that they will have a hearing . . . but stick to your guns, you are right to sack him! If he infor here is correct he will just have to pay your court cost (And his own!) at the end of it! Tell him that and it is usually enough to stop the peasants from taking further action!
