joleen j | I sold something on ebay and the buyer didn't get it. Do I have to refund their money? |
I did write in the auction that I am not responsible if they do not purchase insurance and they did not. They also paid by money order. Additional Details Wow that was awesome everyone replied so fast. This was the first time this has happened and now the buyer is calling my house! she took 11 days to pay and i shipped it 2 days after she paid. She keeps saying she is going to file a dispute. I am going to tell her that she can I will not give her any money back. I think she probably has it and it was almost $100. |

I've been an Ebay buyer and seller for along time. If your auction states that you are not responsible for loss or non-delivery then you do not need to refund. But the other responders are right - the buyer has the right to leave neg feedback - you can respond to it for all to see but the numbers are the same. My policy is to let the buyer know that appropriate feedback will be left for them once they have done the same for me - that gives me the option to leave feedback on them as well should I feel they were being unfair or rediculous. Also, I will refund if I feel that it is worth it but only the purchase price minus ebay fees (i state this in my auction)- never shipping - if the item was $5 then refund it and make insurance a requirement as well as delivery confirmation on all future sale (that way it's covered and you know whether they are being honest about not recieving it)..if it's substantially more then take the hit - you can't please everyone. In the future state very clearly what you will and won't be responsible for, what your refund/return policy is, and that insurance/delivery confirmation is always required for the protection of the buyer and never leave feedback until they have left it for you - that is when the transactionis finalized...they may have paid fast but they could be difficult to deal with later and you will have no recourse if you leave feedback first. I stopped offering refunds and still have 100% feedback. |

If you want to continue to get good feedback, then you should refund the money. If you choose not to then the person will probably write you a negative feedback note that the entire Ebay community will see. It depends on how much your good reputation is worth to you.
You don't have to, but you probably should. |

If you sent it through US mail, or UPS, or anything like that, you should be able to track it and find out what happened to it. |

No, you are not responsible... but... you can guarantee they will leave negative feedback, so you should decide if it is worthwhile to refund the money - or take the hit on your feedback. |

If you can provide proof of delivery, you do not have to refund their money, the feedback thing is a different story. If it is an isolated incident, most people will overlook it in your feedback if you have a lot of positive feedback and only this one negative. |

If you did state that you're not responsible for any lost items, then you don't need to give the buyer a refund. You'll probably get a negative feedback though. However, if you can provide some type of document stating that you did send the package out, like a delivery confirmation, it should be okay.
I wouldn't give the buyer a refund since he/she decided not to buy insurance. |

I sell on ebay and I have had similar problems. The item wasn't received as soon as the buyer thought it should. I waited a few days and it did arrive. It depends on how the item was sent and the distance how long it would take to get there. Sometimes it takes 2 weeks. I would not refund the money because you did state that you were not responsible for lost or damaged items. For ultimate answer though, check the ebay seller help menu. Hope this helps |

Did you ship it by way of having a tracking number. If you did I would suggest that you try tracking the shipment. If you sent it by the post office you can try to call to see if they have any unclaimed packages. If not I would assume she got it and fight her dispute on ebay. |

You do not have to refund the money because you clearly stated in your auction description that "you are not responsible if they do not purchase insurance, etc."
However, the user will probably give you bad feedback, but again, you have the right to leave a comment to their feedback to help "clear your name". |

You might think about giving a partial refund as a gesture of good faith even though you said buyer is responsible. |
