I work for a small business and am off sick, does my boss have to pay me sick pay for a certain amount of time
or do i have to claim stat sick pay? she says she doesnt have to pay me anything?

The info below may help, it is from the Department of Work and Pensions goverment website.

Statutory Sick Pay (SSP)

What is it?
SSP is paid to employees who are unable to work because of sickness. SSP is paid by your employer for up to a maximum of 28 weeks.

SSP is not paid for specific illness or treatment but to all employees, who are incapable for work and who satisfy the conditions for payment.


Can I get it?
You must have worked for your employer under a contract of service. Even if it is your first day of work with a new employer and you become sick part way through the day you may be entitled to SSP.

To get SSP you must be:

Sick for at least 4 or more days in a row (including weekends and bank holidays). This is known as a Period of Incapacity for Work.
Earn, before tax and National Insurance an average of £87.00 a week. This is called the Lower Earnings Limit for National Insurance Contributions (NIC). The amount you need to earn is lower than the amount when you have to start paying NIC’s or would start paying if you were treated as an employed earner.
Your earnings are averaged, over an 8 week period before your sickness began. This period may vary slightly depending on whether you are paid weekly or monthly paid, or at other intervals. If you have just started your job the calculation may be different, contact your employer for more information.

If you answer YES to all the above, claim SSP

If you want to know how much you have to earn for NI purposes, contact your Jobcentre, Jobcentre Plus or Social security office

When does SSP start?
SSP is a daily payment and is usually paid for the days that you would normally work. The days that you would normally work are known as Qualifying Days (QDs)

SSP is not paid for the first three QDs, in any period of sickness unless it falls within a linking period. See - What else should I know for information about “Linking Periods”


How much will I get?
If your average earnings before deductions such as tax and National Insurance (NI) are £87.00 a week or more:

How do I claim?
Telling your employer you are sick

To get SSP, you should tell your employer that you are sick as soon as possible. You employer may have their own rules for when and how you tell them you are sick (please check with your employer).

However they cannot insist that you tell them:

in person
earlier than the first qualifying day or by a set time
on a special form
on a medical certificate
more than once a week during your sickness
Your employer may not pay you SSP if you tell them you are sick more than 7 days after you are first became sick.

Evidence that you are sick

Your employer will ask you for evidence that you are sick. This will usually be in the form of a sick note from your doctor.

But your employer cannot ask you to provide a sick note, for the first 7 days that you are sick. They may ask you to fill in a self-certificate of their own or form SC2 which you can get from your GP's surgery, your nearest HM Revenue & Customs office or HM Revenue & Customs website.


How is it paid?
Your employer will pay SSP to you in the same way and at the same time as your normal wages.

Paid sick time is a benefit offered by many employers but it is not required.

It is generally in the best interest of the company to offer a certain number of paid sick days per year, in my opinion. This prevents employees from having to come to work sick and infecting the rest of the business because they can not afford to lose pay.

I work as a loans advisor for a reputed bank this is one of the question we ask customers if they get sick pay or not - as your employer she doesnt have to pay you anything that is correct but what she has to give you as a minimum is statutory sick pay this is just over £70 a week and the maximum time you can claim on that will be for 6 months no more.
If you are of work longer there are other benefits available but none will be as good as your income.
One thing I will advise you is to go over your contract by yourself carefully just to make sure she doesnt owe you anything
a lot of small businesses do give sick pay if you tend to have been with them for a certain length of time

PS When you get better give your employers the boot and start working for someone who will give you good sick pay im on sick myself too and have been working for them for just over 4 years but i would be able to claim between 6-8months full pay i just hope im not off work for that long lol

Since there is nothing in writing, I would suggest using vacation time. If you do not have any paid time off to choose from, my next suggestion is to contact the labor board in your area to see what is required of your employer.

No, your employer is not required to pay you if your out sick. The only way to get paid is to use a "sick day" and even then you need to make sure you actually get paid for taking off. Every employer is different but they are not required to pay you for a sick day unless it is stated in your employment papers, employee handbook, ect.

How long have you been off sick? How long are you going to be off sick? I presume for starters, you have actually been to a doctor who has provided a Certificate for you to give your employer. If you haven't then you can't expect any sick pay. However, I was under the impression that all Contracts of Employment had to include clauses covering sick and holiday pay. I know that with small businesses (I ran one for many years) it was a real drain when employees were off sick, whether for real or malingering. Why not ring Citizens Advice Bureau.

If there's nothing in your contract then she does not have to, by law pay you sick pay.

I, myself get 2 weeks "sick" then it is unpaid and I have to claim ssp. I would assume yours would be the same except for the 2 weeks sick part!

Are you an hourly employee? Then sorry. No sick pay.

Companies who offer sick pay let you know when you're hired. It's considered a benefit. Usually only salaried employees get it. In any case, they would have informed you when hired if it was included in the benefits package.

If you were not told on the hire date that you would get sick pay then no you boss does not have to pay you; and guess what she probably won't!!! Especially if it is a small business, they struggle enough when one employee is out and it causes the loss of money why would she want to loose more money by paying you for when you were not there and not making her money!

I think as long as you get a doctors certificate then she has to, but sometimes its only if your a permanant employe not a temp
