You can't sell a competitive product that contains the name of your competition's product.
That's why there's not a Whopper or Big Mac at Joe's Burger Shack.
McD's has huge pockets and a short temper. If you're serious about an ice cream shop, find a different name, or suffer the lawsuits that are sure to come.

As others said, no you can't, McDonalds has a trademark on the McFlurry, and in the sort of business you'd be running, it's obvious that you'd be attempting to cash in on their brand and product.
This is fairly basic trademark/copyright knowledge. If you don't know what you can and can't do, I recommend employing a lawyer before you make any business decisions. |

I don't think it's illegal, but you'd be exposed to suit for trademark infringement by mcdonald's. Whether it's formally registered or not, "mcflurry" is undoubtedly a trademark of mcdonald's and as such cannot be used to market similar products without their express permission. You could try it, but if they ever caught on (which they almost certainly would, eventually) your business would go down the tubes in a cold frothy cup of litigation and judgment liens. Come up w/ a different name and good luck w/ your business! |

Probably. Most likely McDonald's Corp. has trademarked "McFlurry" and would likely sue the pants off you for using it. Though if your surname actually happened ot be McFlurry, you might have a shot. |

McDonalds may not like it but check the McFlurry container...if it says copyright on it then they will probably sue you.
However if it says TM then i don't know where you stand as technically if the name hasn't been copyrighted you could use it for your business?!!! Perhaps not for your ice cream though. |

what you need to do, is check with the company mcdonalds and see if the name McFlurry is copyrighted. If it is your screwed. ALSO check with a company that keeps records of patents. |
