no you have to have a permit or a vendors license depending on your state, you can call the non-emergency police department number and ask if you need one for your particular town and ask if it is available and where. Most likely at your local government center, etc.. |

Obviously some of the answers posted already are just going for the 2 points-they don't have a clue what they are talking about. This type of answer could get someone in serious trouble if they believed it! Laws governing sales, vendors, etc. are different in EVERY SINGLE COMMUNITY. So the answers like 'yes you do' are false and show lack of true information. In Vermont, for example you have to register any business with the state-because of sales tax they have to collect. Street vendors have to register in SOME of the cities to get a vending permit. In New Hampshire, you can open up almost any type of business and NO permits are required from the state, except for licensed business-like hair salon, doctor, etc. But each city and town may have a permit required for a 'storefront' business, or they may NOT require anything!
Our city requires NO permits or registration for any business not regulated by licenses, but you MUST get a 'vendors' permit EVERY DAY if you are going to sell 'on the street' , etc. So it varies in every city, town, and state.
You have to check at the city hall/town clerk's office of the community you want to sell in. There is no 'universal' license that allows you to do it everywhere-you have to find out what your area requires.
If you are selling food products, you may have to provide a source of hand cleaning, storage, etc. for food, supplies. This would also require a food/restaurant license and inspection.
Some towns and cities might not have any licenses needed but you need to check-ignorance of the law 'but officer, I didn't know I needed a permit' will NOT get you off the hook.Some cities may have a restricted number of 'permits' and auction them off for a specific time period-to prevent 'just anybody' from setting up an illegal sales site.
So figure out where you want to sell and call that local city hall or police department and find out who to talk to.
And keep in mind-just setting up to sell on a 'vacant city lot' could get you a trespassing charge-just because a lot is vacant doesn't mean the city owns it-if it is privately owned the owner can have you arrested! |
