If it's a strictly oral agreement, with nothing on paper and no witnesses, then neither party has an upper hand in proving their side, and essentially it would be a draw.
If it went to mediation, they would undoubtedly try and get the parties to agree to compromise at 75 cents, but there would be no way to legally enforce that, though faced with the expense of paying to have his oil shipped back to him, Jim would be foolish to not seek a compromise. |

and in court it doesn't "prevent" any enforcement as that's why they are in court to begin with. this all being said beside the fact that they would obviously have gone to court BEFORE the money switched hands. My bet is that this would be tossed out awarding neither party anything, and both parties free to take their business elsewhere. |
