My ex-boss is witholding a paycheck of mine. How do I get it without involving lawyers?
I worked for a guy for a few months in the fall through December. He still owes me for 14 hours of work and he's not paid me. I wrote him a letter asking him for the last paycheck and he said "When you give me my box of personal belonging back, you'll get your check." I shipped his box priority, at my own expense, and he received it over 2 weeks ago. And of course, I've not been paid for my hours. How should I go about this now? I don't have money to hire a lawyer or even to sue him myself for it. And I really need the money. He's just being a jerk. Advice?

I've already threatened with the lawyers. I did it in a nice way though. He replied that "he had lawyers at his disposal as well".
And I don't know if the state labor board will work - he had me keep track of my hours and hand them in weekly to him and I'm sure he'd lie about it if it escaladed.
AND, he's a private practice doctor. He IS the boss. He has no boss. :(

i would contact your state's labor board and find out what your options are. they may be able to help you without contacting a lawyer. if you are unable to get help through them, i would contact your local "legal aid". this is a group of lawyers who will usually give you legal advise, or even actually work for free or minimal cost.

And if reporting to the boss doesn't work, try the wage and hour division of your state's department of labor.

About the only thing you can do is ask nicely.You can always mention a lawsuit and hope it scares him into handing it over,but don't hold your breath waiting on him!

you are entitled to collect not only your paycheck, but some kind of fine, or get paid for every day that he's been withholding it, or make interest off it, or something like that. I wish i could remember exactly. My friend collected extra but it's kind of foggy to me now. In any case, you should definitely look up a lawyer online who specializes in employment law/overtime law etc. because a lot of them work on a contingency basis, so you pay them only if you recover the money. All it will take is one letter from a lawyer and you will recover your money. this jerk won't hold out. but then the lawyer will get about 35% of it. but i think with the extra stuff your employer now owes you (on top of your paycheck) it may be worth it. especially since you have 0 now. there is a service where you can post your case at legalmatch.com for lawyers to review and contact you.

Look up contract law on the internet. Also look through tort law. Contract law and employers will be most helpful. In this case employer and employee (that's you) had a contract. You provided services and the employer owes you pay. After your original contract was formed and executed your employer set forth another stipulation before he'd pay you and you complied. The employer is in breach of two contracts now. If's he's not careful he could end up liable to you for more than just your pay check amount.

I suggest that you pretend to involve lawyers. Get the name of some lawyer and maybe look up a law that says you have to be paid (it doesn't have to fit perfectly - it's just to scare him), and go see him in person.

You probably won't get anywhere over the phone, unfortunately. Of course, you should call first to make sure that this isn't some kind of misunderstanding.

Unfortunately, you might have to threaten to get lawyers involved to see if that does the trick.

Contact the Labor Board, it is unlawful to withhold a paycheck based on any reason due to the fact you have already worked for that money. If you owe a company they must settle civil matters with you in court unless it's crim.In some cases a lawyer may take this case "pro-bono"(free) Depending on the company.
