It won't go through unsigned. They did it on purpose - delinquent payees often do this "oops" they will say. "Must have forgot"..."was so worried about getting the payment to you..."
If you live within driving distance, head over with the check and ask them to sign it. |

Its a ploy of some companies to keep their money in their account for a bit longer, there probably having cash flow problems, as i suspect you will to as everything has a knock on effect its a way of the world, i would ring them and give them you bank details getting them to pay you directly into your bank account then get them to send a confirmation when they have done it. |

Simple Answer: NO, you can not sign the check. Two wrongs do not make a right.
This is a case for the District Attorney's Office. Make sure you can prove length of time the account is "over due". The DA may consider maleficence and bring it to bear on the issuer of the check. The DA usually gives the issuer "one request to send to the DA a check". If he issuer does not, "hello court time". |

as far as I am aware this check is useless unless signed by the payee,dont sign it yourself as this is illegal ,there is no point in depositing it as the bank wont accept it,and the way banks are they would propably charge you to tell you its not acceptable,in a situation like this ,I wouldnt think the worst unless they have a history of bad payment,phone them up and explain that they have inadvertently forgotten to sign it ,explain that you need this payment as positive cash flow is very important to the running of your business etc, ask them to make a payment of the sum owed via a bank transfer into your account first thing in the morning,alternatively if they didnt wish to pay directly into your bank,please send a signed check first class post tomorrow,registered if poss. |

Your bank will not accept an unsigned check for deposit. If it is a local company, maybe drive over to get it signed. |

You are being scammed. If you are desperate for the money drive it round or hire a debt collector local to the company to take it back for signature.
If you forge that cheque you could go to gaol. (Jail for Americans). Also, you will hoplessly cloud any litigation you need to pursue to get the payment.
If you cannot get the cheque signed in person I would at the very least get them to sign an acknowledgement of debt and that the work was completed properly with a payment schedule. Otherwise if you do sue them you will suddenly start hearing about "defects" in the work. |

Do not sign it yourself. That is fraud and could get you into trouble. If it is a small check, you could try to deposit it without a signature. If the teller doesn't catch it, it will probably go through.
If it is a large check, the bank may check it more carefully. What is large enough to make it a large check? Sorry, I don't know, and that probably varies depending on the bank's policy.
I once received an unsigned check (about $500) under similar circumstances. Believing this was no accident, I decided to deposit it and see what happened. The check cleared with no problem.

If i were you I would just go ahead and deposit it. Maybe the bank will cash it without even realizing it wasn't signed. I wouldn't send the check back to the company. Is there someone you can contact from the company to have them come by and have it signed? |
