My employer recently told me that business is down and that she will have to make adjustments. I am currently a Salary employee. I have been employed for 5 ½ years and work 40 hours a week. I want to know if my employer can take me from salary to hourly and cut my hours? Also can they offer me part time work and if I decline will I be eligible for unemployment? |

I have never been to MD, But in Texas you will be able to get unemployment if you are fired. If you decided not to take the part time job. Make them give you a better offer. If they cannot offer you a full-time job then, Contact your unemployment office and tell them your situation before you quit. Ask them what would they suggest. More than likely you will recieve unemployment because this is a situation out of your control. |

I am not a lawyer and I've never lived in Maryland.
But in most states your employer can fire you completely or lay you off.
If they offer you part time work and you refuse you'd probably lose your eligibility for unemployment.
I'd suggest you call your local office of Employment Security.

Do you have a employment contract in effect? If not, you really don't have a dispute. They can change your pay status as easy as retitling your position. At least they didn't just fire you and you still have a job. They could just terminate you and bring in someone new for less pay, so you must be a good employee. Try to negotiate in other areas since you have been there so long. Maybe they will comp your benefit package due to your salary cut. Hang in there with them if you can and maybe the payoff will be greater when business picks up. Loyalty means a lot when companies are going through a rough period.
As long as they offer alternative employment you are not eligible for unemployment. |

Unfortunately, if you are not under contract there is not much you can do. This is considered employment at will and you have the option to quit whenever you want. |

Your employer can change your job and hours and salary almost at will. They can't go below min wage and they can't punish you for race, sex, age, religion, etc. If buisness if bad and they need to cut expenses that is a valid reason. You're lucky, most buisnesses simply let people go. If they change your status and you quit I doubt you will get unemployment. After all you would still have a job but I would check with the state first. Maryland is pretty good about loading expenses, taxes and fees on buisnesses. |

If they fire you, you will be able to get unemployment. I don't know about MD's specific laws, but if they reduce your hours, I doubt you will be eligible for any unemployment, the same if you quit. You might be in MD, but I doubt it. Unless you have a contract for a certain number of hours or a certain amount of pay, they can reduce either at will whenever they want. They are not obligated to keep you at a steady wage, you can quit any time, so they can reduce your pay or fire you at any time, within the limits of the minimum wage and other general labor laws. |
