I am married and had my baby 8 weeks early. My boss didn't have a temp lined up and couldn't find on short notice, so she fired me and hired someone esle permanently. I lost my health insurance and half our income just when we needed it most. Legally, I couldn't do a thing, because my office is not covered under the Pregnancy Discrimation Act due to having less than 15 employees. The Employment Commission has already ruled in my favor and granted me unemployment for 23 weeks. My boss has not said one bad thing about my work performance, in fact she has said nothing but good things to the VEC. She even wrote me a letter of recommendation. Should I fight for my job back or compensation or should I let it go? Additional Details I was employed there for a year and a half. My boss told the Employment Commission that the sole reason for letting me go was that I had a baby and needed to be off for 8 weeks per my doctor and she couldn't go without an assistant for that long.

Well, in some cases, if you've been employed by the same company for over a year, you are entitled to FLMA, which is the Family Leave Medical Act, which basically keeps your job safe until you return to work. So, has it been longer than a year? I think even under 15 employees is covered by that, but here is my opinion, if you boss didn't care enough about you to keep your job safe, that tells me I wouldn't want to work for him in the first place. Go find a better employer. |

It sounds like some type of discrimination to me. It was obvious to them you would have a baby and they had plenty of notice in this when you started to show. I personally would collect the unemployment for the 23 weeks, in that time I would put out resumes or applications to family friendly companies. There are Forbes companies that are just that. Those will be very good to let you put your family first and take off if your child is sick or has a snow day and no child care,etc. This place doesn't sound like they would allow that.I wouldn't return to a place that was willing to easily let you go.

Fight if you really love that job. But do you really want to work for them after they dropped you because they were unprepared? I would find a better job with better benefits especially now that you have child

Is it worth a fight? If your skills are marketable, then why not place all your energy into interviewing for a new employer? The letter of recommendation is a gold-piece to a new job, use it wisely. |
