bb | What does without predudice mean? |
|
|

Basically - If a solicitor says something in a letter to you, and it includes without predudice - it means that what ever they say is not legally binding i.e. they admit guilt - you cannot then use that in court. It means nothing - anything they say can be changed - its just checking the water to coin a phrase...
Be carefull!! |

it means not being judgemental on how someone is not stereotyping someone and being totally bias. |

its a term usually used in legal documents
effectively it means that anything discussed in the letter cannot be used in court.
its meant to be a mechanism to explore possible solutions without admitting liability, or without opeing the letter for further puiclic discussion |

in legal terms if a case is dimissed "without prejudice" that means it is dismissed but can be refiled within the specific time limits. if a case is dismissed "with prejudice" it is dismissed for good and cannot be refiled. sometimes a case is dismissed "without prejudice" if "time" is running out. this often happens in civil suits or in a criminal prosecution before trial. a prosecutor may dismisses a criminal charge if their case is falling apart ( like can't find a key witness or as incentive for the defendant not to get in any more trouble, i.e. "your charge will be dismissed, but if you get another charge within the statutory period , we will refile the charge that was dismissed "without prejudice" along with the new charge". in a nut shell "without prejudice" leaves the door open to possibly reopen or refile the case in the future. |

if you received a judgment that said "without prejudice" from the judge, then that means that if new or other information is gleaned in the case that within a reasonable period of time you can bring the case back to the court for re-determination.
I've done my own personal cases (I'm a paralegal), after having worked in law offices 14 years. |

Do you mean Prejudice? Predjudice is not liking a certain group...like whites, blacks, puerto rican's, oriental's...etc. That is only to name a few! |

the legal term means the verdict can still be changed.
to dismiss without prejudice means that no actual ruling as to fault has been entered. after certain issues have been resolved court can reconvene on a case.
EDIT >>> jack frost down below has it completely backwards, lol. |

When a case is dismissed without prejudice it means that the Judge who oversaw that particular action before the court deemed that it was completely and fully closed. In other words the case cannot be reopened on the same premise as it was originally. Now, if a case is dismissed with prejudice, it means that the presiding judge feels that there is more to it, but due to any number of reasons (i.e. lack of evidence, missing or uncooperative witnesses, legal technicality, etc.). In short if you get a case dismissed without prejudice you cannot be brought back into court on any of the existing evidence. |
