Ok my job is I work in the printing industry for a family owned business (not my family) I work with my friend, his brother, and their dad. Here are my problems...I am NEVER able to get 40 hours a week (2 brothers open the shop and their dad is never there). They are supposed to be there at 730am and dont get there, on average, until 740-745. Same thing for lunch except everyone is only 30min long. Problem is, brothers are on a salary which they dont really care when they get to work or come back from lunch and I'm left being screwed. Their dad knows they get there late everyday but from what i've seen he hasn't really said anything to them about it. Also they make more than double than what I make. And just today I was ordered to go on a lunch even though I didnt want to only because I have to make up time for them being late everyday but they told me that, thats illegal?!?! What would you do if you were in my position and what they said..about not taking lunch illegal? |

Yeah every 5 hours you work, you have to take a lunch for at least 30 minutes...well that's the law in California. Not sure why you would have to take one to make time for them being late or whatever. Maybe you should quit and go to college. |

Nope, I could not be happy there!
A lot can depend on where you live as well as the owner's policies regarding workplace rules. A lot of it is goverened by the state and federal rulings, but believe it or not, a lot of it is left up to the business owner(s).
If you feel you are being treated unfairly, leave! If that is not an option, seek the guidance of someone qualified.

I don't think it's illegal, I think its just a company policy thing. At my work they won't allow me to work more than 6 hours in a day cuz otherwise they would have to give me lunch and they don't want to do that. |

You are in a no win situation in this job. You have two options, put up with what is going on or look for another job.
You are never going to change this within the family dynamic, you can stay long enough to gain work experience, but you are getting the short end of the stick here.

I say find a new job because the father will always treat his sons that way It'll never change. You will always be treated poorly-get out while you can!!! And about not taking lunch being illegal-you need to check your state laws on that. Every state is different on "taking breaks" they have different requirements or you may contact OHSA!!! |

If your employer says there is a lunch break during your work day and you work through it without their permission they are not obligated to pay you. I know at my job you have to ask your boss to work through, if they say yes then fine...you get paid for working through lunch. If they say no you can work through but you're not getting paid for it.
My advice is get a new job. It sounds like you feel underappreciated. plus working for family owned places is B.S. They only care about themselves and their $$$$. |

If you work 6 hours per day or more and are paid hourly, the employer must give you a lunch break of at least 15 minutes, however, they can give you a paid lunch break, or they could make you a salaried employee. You should discuss with them that you enjoy working for them, however it has become financially difficult for you to keep irregular hours and ask if they would consider a paid lunch break or perhaps make you salaried. Do they trust you enough to be the shop "opener" in the morning so you can start on time?
Perhaps they would be relieved to know someone is there at a set time and they could even linger in a bit later. Need to sweeten the pot for them if you are to get what you ask for so prepare for the what ifs and have a sit down chat at a scheduled time so you aren't awkwardly asking in the midst of a work day.
