I have a retail store. Me and my parents are on the lease agreement. But on the tax returns and tax IDs, it is my name 100%. The accountant put me as President and 100% owner on the tax returns. So who is the rightful owner of the business? My dad is threatning me to kick me off of the store. hey, this is more of a family matter than a legal one...i suggest you talk to your dad and get this over with...you must meet the criteria for being a store owner:
1. Who conceptualized the idea of a retail store?
2. Whose money was used to pay for the permits and certificates that comes with putting it up?
3. Who is in charge of the operations?
4. If you have a bank account in the name of the retail store, whose signature is needed to transact...
these things will guide you in your attempt to establish the rightful owner of the reatil store... |

The taxes don't much decide ownership of the business. It's the listed responsible parties for the LLC or other incorporated license structure.
If you're the sole proprietor on your Limited liability corporation, then you own the business, regardless of who files your taxes.
If you haven't incorporated, it becomes a little more hazy. At that point, you have to start looking at which one of you owns the majority 'assetts' of the company. It's inventory and interests, including real estate, land, and leases (retail locations).
Good luck to you! I have to be honest, if you're looking for advice likethis and are unsure who is the rightful owner of your company, I'd recommend speaking to lawyer, and getting Incorporated right away.

Sounds like it's your business. Just because they are on the lease for the building doesn't mean they own any part of the business, only that they have the right to occupy the space. If the business is in your name, and you pay the taxes, and the tax ID number for the business is in your name only, and the company or corporation is registered to you, it's yours. If you leave, the inventory goes with you. |

Who is shown as the owner with the State? Are you self-employed or is the business a corporation? If you are self-employed & the tax ID's are in your name then you are the owner & you have yourself a lease problem. If you want to stay where you are you will have to get your parent's names off the lease or move the business to a new location if you can get yourself off the lease.
However, it sounds as if the business may have been incorporated which means that you and your parent's are employees of the corporation. You need to see an attorney or call the attorney who set the corp up for you to straighten this out legally. |

your parents are only responsible for the lease. well, half of it. this is your business and the worse your father can do is walk out and leave you fully responsible for the lease. it's completely up to you but you can bring him to court and sue him for his share. your parents name on the lease is completely separate from the business. i do hope you're incorporated. this will protect your personal assets no matter who sues you if this ever arises. also, you being the president gives you authority to fire, hire, and any other business decision. i hope you and your father can work things out. but he has no power to kick you out. especially since your name is on the lease too. you are fully responsible for your brick n mortar store until the lease expires. at this time you may choose to relocate to a new building with your name only on the lease, or a better option at renewal of the current lease place your name only on the contract. |
