Would the Supermarket be liable ...Please Read?
I work at a supermarket and our ice cream freezers are having problems and the manager is giving away free melted ice cream to the customers, if a customer gets sick from this melted ice cream that he/she takes for free at their risk, are we liable?

Not likely. And nothing should be wrong with the melted ice cream. Unless it's been sitting out and gotten warm.

Yes, if it is due to the ice cream itself being spoiled and not because the person is allergic to or has an intolerance to the ice cream. The ice cream becoming warmer won't in itself cause it to spoil because it takes time for that to happen. If the ice cream is okay upon handing it out, then it is still up to the customer to properly handle the ice cream by either eating it right away or by freezing it to keep it at a proper temperature.

Wow. I think it would be based on the opinion of the judge. They did take it at their own will but they would have to prove it was the ice cream that made them sick first of all. And since you didn't charge I really don't think anyone would see any harm in what you guys did. If I had to guess you guys would be fine. Most people don't get sick from that anyways. It think some ppl exagerate for extra cash.

a person can go to court for any reason... if they file a complaint.. the court would have to decide ..under the circumstances it would be better to throw it out and put a clain in on the insurance.

Unless it it TOTALLY melted, as in like soup, no. I am sure he is getting rid of it so that it isn't wasted. Whether he gives it away or throws it away, it is covered by insurance (faulty equipment) and he shows it as a loss on his books.

I think it depends on the person. Some people will think it was their own risk taking the free ice cream. Others might blame the supermarket.

Yes, Supermarkets would have liablity insurance against that, but yes you would be.
