2 kids living with us,We sent proof to IRS, They rejected it ,parents in military?
We sent school attendance records to IRS. We claimed them in 2006,stepfather claimed them in 2007 before we filed, he's in a differnt state, waiting for letter back from IRS With rejection
Got the phone call monday. The IRS on the phone said we were not the custodial parent ,SO WE COULDN'T CLAIM THEM. How do you fight with the IRS?

Man, that sucks! This should have been settled before the children's mom left them with you.

If the step father filed married, filing jointly, then he can, in fact, claim the minor children. I'm not sure if her signature is required for that return if she's out of the country.

You need to speak to the custodial parent, and ask them if they signed their tax return that claimed the kids. If not, then it's on them to file an amended return and give you the deduction. If they did indeed sign the return, then you're out of luck, because there was no agreement beforehand.

the test for whether a child is a dependent includes more than going to school from your house.

you have to make the case that you provided over 1/2 the children's support in dollar terms. support is food, clothing, shelter, insurance, school tuition (if any), etc. see page 16 in Form 1040 instructions.

since the parents are in the military, they likely get allowances for the kids.

You can fight with the IRS all the way to Tax Court and maybe even after that to the Supremes. The best first approach is simply to file an appeal. The IRS will tell you all about it. Go to:

If the children lived with the stepfather for over 6 months in 2007, excluding temporary absences, then he gets the exemptions. The IRS typically views absences due to military duties as being "temporary" even if they last all year -- and given the sacrifices of our military folks, that's as it should be. Sorry.

Page 15 has a piece to determine fi they were YOUR qualifying child. The part it sounds liek is missing is are they related to you in any way or adopted or fostered?
Are they sending you monmey to help support teh children?

IF they are related then it soundsliek you met all the qualifications to me and only need t PROVE it.

Who files first has nothing to do with it. Bostonian is right...the parent(s) that the child lives with MORE THAN half the year and is supported by that parent is the person who can claim this child's exemption UNLESS a court order has been established saying otherwise.

When I took a tax class years ago they told us when it comes down to either parent may claim them it ends up who ever files first. So even though you have had them all year if he filed first they maybe nothing you can do. He says that him or the mother previded for them even thought they were living with you. I would talk to someone who dose tax returnes and see what they say. They should know or know what Pub to look in and find out. Good luck

LOL You can't fight with the IRS. One thing could of happened is the step father could have claimed them again. That is one thing you should check out. Also it is true you need to become temp. custodial parents. Maybe this is something you can check out with the mother so you can get help. This just gives you all right as parents until the real custodial parents are able to resume responsibilities.
