he has been at this company for 8 yrs ,3 weeks ago his company changed from allclean services to allclean limited, and this week his p45 was in his pay packet, the reason he is being told is that he is with a new company now,does this mean he has lost his 8yrs service,and if his boss shuts the business down he will owe him nothing ( his boss is winding up the business within the next year or so). does this sound a dirty trick or is this the proper procedure |

He is entitled to redundancy under the same terms as the original company terms and conditions. The legislation is "Transfer of undertakings".
In a nutshell if one company takes over another (contrived or not) then the workers are protected by their employment contracts that they signed on joining the original company. All terms must be honoured by the new company.
Tell your friend to find a solicitor. |

It sounds like he may have more rights than you think, if he is being let go, rather than just a paperwork issue of passing from one employer to another. |

Seek proper advice - it sounds like he has a case under Transfer of Undertakings but you need someone with all the facts at their disposal to be sure. |

He should have been transferred to the new company under the TUPE arrangements which mean that he keeps his terms and conditions and previous service. The company should have written to him to confirm this - if they havn't, he should ask for confirmation in writing. |

Firstly, it should have been only the blue copy of his p45, and he will still be entitled to his 8 years service based upon the information you presented.

In my experience where I work the company has changed hands Four time in 26 years and I've kept my long service record and my contract conditions haven't changed at all.but my job has been at risk and I've had to go though being interviewed each time to keep my job.
If your friend has received his P45 he should have been interviewed and told his position and he should be entitled to redundancy pay as well. |

Its an attempt at a dirty trick so see a solicitor. His boss is typical of the tossers who try to steal from genuine workers whilst feathering their own nests.
I dont know which idiot gave this answer the thumbs down, unless its sour grapes, but I have a legal background and the answer is correct. |
