A friend recently informed me my getting salary may be unlawful or shady to say the least.
I am a line cook in a restaurant with absolutely no supervisory or executive powers (prep and cook thats it).
I work roughly 60 hours a week. and i am compensated between 600 and 700 a week.
My friend says that since i am a non- managerial position, i should not be exempt from overtime and thus should be getting paid overtime for the 20 hours im working.
BTW I am in the state of Massachusetts and the job is considered seasonal.
Thanks for helping me clear this up. Additional Details I must admit, the pay is decent, but housing
(def not cheap) and taxes come out and it is only marginally more than when i was hourly at 15 hours LESS |

I believe that you are entitled to overtime. However, it also seems that you are well paid. If you complain, you may lose a good job. It seems like your employer has given you a high weekly salary to compensate you for some overtime. |

Since your pay varies from week to week, as you say between $600-$700, I'm guessing you are being paid hourly. A salaried person's pay stays the same each week.
Also, based on the amount of money you are earning it sounds like you are getting paid about around $9.50 an hour:
9.50 x 40 = 380
14.25 x 20 = 285 (this is time and 1/2 for 20 hours per week)
380+ 285 = $665 per week |

It depends on what your agreement was with your employer when you took the job. If you agreed to an amount--more or less salary, then it will not matter how many hours you work
did you agree to X $ hour? or did you agree to X$, period?
for the salaried amount, you might work 60 hours but you also might only work 30 but still get the same pay
you need to ascertain what your employment agreement was from the outside--or don't you remember? |
