Donna B | Anyone ever claim gambling losses on tax return? |
I won 25,000 on lottery and paid 25% taxes. If I claim equal losses, will I get back what I paid in? |

Another thing the IRS will look at is if you only report what was won that was reported on a 1099, they will wonder what you won that was not reported as income.
1099's only have to be issued if the amount won is over $600. You are supposed to report ALL winnings regardless of amount on your tax return. |

Winnings of this size are routinely audited. You can deduct losses up to your winnings, but you must have detailed records of your gambling activity: where, what, with whom, how much lost, etc. Keep a diary of this.
Will you get it all back? You would get it all back if you have other itemized deductions that equal or exceed your standard deduction. In this case, the additional $25,000 deduction for gambling losses would fully cancel out the winnings.
If you had no other itemized deductions, then you would get back up to about 80% of the tax withheld, depending on your filing status. |

One person tried that. He collected a lot of lottery tickets on the notion that he can deduct the losses against his winnings and not pay any taxes. He got caught for tax evasion. The IRS knows that people who make $50,000 a year, don't spend $10,000 or even $2,000 (that's 5 tickets a day, every day for a year) on lottery tickets. There just isn't enough money left over after you pay regular income taxes and living expenses. That's a red flag and you'll be audited. Possession of lottery tickets in this case is not enough proof. Look at the dates of the tickets and the places where they were purchased. Going to a few different stores each week or a few stores a day throughout the year isn't a normal thing that someone would do. You'd have to have proof that you did that. |

Maybe, if you itemize - otherwise, no. And if your bracket is less than 25%, you'll get some of it back since you'll have had more withheld than you owe.
Proof is needed of the losses though - you can't just show up with $25k in losing tickets and say here, this evens everything out. The IRS auditors are well aware that people can get losing tickets from their friends, or pick them up from the floor, parking lot or wastebasket of lottery outlets. Read the rules for claiming gambling losses. You need to have a written log, kept up all year through the year, of ALL of your gambling activity, showing all gains and losses and a number of other required items. |

IF you can prove them you might, but it depends on your other income, and whether or not you itemize your taxes. You need receipts, Club printouts, lottery stubs, some proof of the losses. You can claim losses only to extent of your winnings, and with proof. If your tax bracket is lower than 25% you'll probably get something back anyway, unless your winnings push you into a higher bracket. You haven't PAID taxes on your winnings, you have had withholding for taxes. |

Yes... just make sure to save receipts, tickets, etc... you may need to present these documents. |

It sounds like you should. The only thing though, lottery winnings are taxed at a higher rate. Make sure you have lottery tickets to back up your claim of equal loss. |

No.
1. You must have proof of the loses. Did you save your losing tickets?(pub 529, page 12).
2. The winnings are added to your AGI. AGI may affect your ability to deduct other items on your tax return. The losses you can document are added to schedule A. If you do not already itemize, only the excess over the standard deduction would help you. |

yes but you must have the proof such as spent tickets to show them. Go through the trash at the stores that sell them and collect all you want |
