The ultimate jurisdiction in a divorce settlement is the decision of the Divorce Court, NOT a written agreement.
In the 20th Century, pre-nups weren't often used by the courts.
However, in 2004, the English Courts upheld a prenuptial agreement and a wife lost a substantial claim. As a result of this, Courts now take prenuptial agreements seriously but they will carefully consider things like:
1) Did the party with the most to lose understand the nature of the prenuptial agreement?
2) Did he/she have independent legal advice?
3) Was he/she under pressure to sign?
4) Was there full financial disclosure?
5) Would an injustice be done if the prenuptial agreement were upheld? |

No, but they should be. Yes you can have them drawn up but they are not valid in a court of law so they are not worth the paper they are printed on. |

NO!
No agreement can be made that seeks to set aside the authority of the Court.
So as the Court is the final arbiter, and you may not set their authority aside, the "pre-nuptial agreement" has no value. Of course, you are free to make one, but if there is some dispute that brings the marriage to an end, then the courts get in on the act, and they will not give any regard to the agreement, although, they might take note of your intentions, to assist in making their own decision. |

No they are not. One you are married, you share everything.
You could argue that an agreement made before the marriage could be presented at the divorce but should there be any children involved, or a change of attitude from either partner then you are going to have to fight with lawyers.....
