DOJ & IRS Petitioned To Explain
On May 12, 2006 in Peoria, Illinois, the attorney for the U.S. Department of Justice (DOJ) begged the court to dismiss all charges against IRS victim Robert Lawrence in federal District Court.
The motion for dismissal came on the heels of a surprise tactic by Lawrence’s defense attorney Oscar Stilley.
The tactic threatened exposure of IRS’s on-going efforts to defraud the public. The move put DOJ attorneys in a state of panic that left them with only one alternative: beg for dismissal, with prejudice.
Stilley’s tactic paid off. Sixty days earlier, the DOJ had indicted Lawrence on three counts of willful failure to file a 1040 form, and three felony counts of income tax evasion. The federal Judge dismissed all charges with prejudice, meaning the DOJ cannot charge Lawrence with those crimes again. Additional Details READ THE ENTIRE STORY HERE

Please, read the Constitution of the United States before you go quoting statements from morons. It's best to think and do some research before you simply believe what someone else tells you.
Amendment XVI - Status of Income Tax Clarified. Ratified 2/3/1913. Note History
The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.
So, since the Congress has the power to collect and lay taxes on incomes, and Congress created the IRS to do that for them, I don't really see how your argument stands up.
I mean, I COULD be wrong, but I'm pretty sure the Constitution is the highest law in the land. |

Federal courts have consistently ruled that the IRS has the obligation to collect taxes under Federal LAw, and the right to prosecute those that evade payment.
You are doing a disservice to anyone gullible enough to buy into this proven urban legend that the governmnet has no legal right to collect taxes. |

But think you for the info.I refuse to file.I claim no excempts on my w2 so pay in max taxes by the charts.I figure if that ain't good enought for the goverment they need to rework their tax tables.Anything they can get before I get my hands on the cash they are welcome to but afterwards its mine. I believe in a flat rate tax system.Put all of the worthless mouths out of goverment. |

Wrong. The case's dismissal had nothing to do with the Stilley's PRA fantasy or any other tax protestor nonsense. The case was dismissed because the IRS agents, working with imperfect information due the the defendant's refusal to cooperate, used the wrong basis in computing the defendant's gain on the sale of rental properties. That error led to an erroneous tax computation. They discovered their error, informed the Judge and Stilley, and requested leave to amend the indictment. That was refused. The dismissal apparently does not preclude charging Lawrence with those crimes again, but rather precludes trying him based on the existing indictment. If the DOJ wishes to proceed, they will have to get a new indictment. |
